    • There won't be a quick solution – and you properly had better get used to that idea. You certainly weren't following my advice. I specifically said that you should begin their complaints process immediately - and I think that you should do that. If you think that I didn't advise this then I would suggest that you start reading my posts – and the other threads on this forum rather more carefully. I think that your correspondence should keep to a minimum the amount of information which is necessary to be communicated to achieve your ends. Unfortunately is too late to re-call the email which you have sent – but it looks like a load of bluster and it will simply bring comfort to Hermes who are well used to this kind of thing. You don't seem to realise that they probably receive hundreds of ranting emails every week – and they all get consigned to the bin. The more it blusters – the less seriously they take it. I suggest that you start reading up about the pre-action protocol and how to bring a small claims in the County Court. That would put your time to good use

You should begin their complaints process so that you can show that you have gone through the proper procedures and exhausted them. Because you are claiming third party contractual rights, it is part of the contract that if there is a problem then you should follow certain procedures. Also, your letter is far too detailed. You shouldn't be disclosing this kind of thing that this point. I suggest that if you want to send any more letters, you post them here first so we can have a look. Also you are already threatening court action – well that's fine – but have you ever issued a county court claim before? Have you any idea of the steps that you need to take? I think you ought to be more careful, more steady – and more subtle and understated in your approach
    • No I've written direct to customer services and copied in the CEO.   Actually, I had complained to Hermes via Resolver previously so I guess I have been through a standard process already yes.    They just said 'Paclink issue nothing to do with us' so trying a more direct approach now.

You should send it to SPML but include Ascenden as agents for their mortgage administration.

Make sure you include the £10 fee and a cooy if your council tax bill to provide a means of identification and proof of address.

Hi, your experience is absolutely typical of Acenden's (mis)management of mortgage accounts. Yes, I know of people who have been refunded THOUSANDS in fees/charges.

 

Make sure you send your SAR to the correct postal address for Acenden (they moved in the past year).

If SPML play silly and say tgey cant provide info from ascenden then worst case scenario is you have to send 2 SAR's, 1 to each.

I sent mine to Spml and received everything from day one to present day from both company's. I hope that helps

Could I ask if anyone knows the correct postal addresses for both Acenden & SPML to send the SARs to?

Also, has anyone had any recent luck with reclaiming unfair charges etc from SPML recently?

Acenden is the sole data controller for SPML-originated mortgages so you write to Acenden, not to SPML. Acenden's address is on the web, isn't it?

If you go to the FOS, remember that the assessors are trained to throw most of the complaints out. When a FOS assessor does that to you, you write back and say that their response is not acceptable and that you want your complaint to go to an ombudsman.

Having read the SAR guide I see that there is no longer a requirement to send £10 for the request but the organisation may charge me for the information at a fee that they dream up.

Would I be better sending the SAR with a £10 PO to see if they decide that a higher charge is required or they return the PO with the information that has been requested.

Also,

As it is a joint Mortgage and always has been do I need to send the request in both names signed by both parties or two seperate requests for both people?

Hi,

 

Is it mandatory to include the account number on the SAR as I think there may have been more than one account with SPML / Acenden since 2003.

 

Can I just send the SAR with no account numbers on it ?

Just completing my letter and would like advice on the following:

Please supply me with copies of all the data which you hold on me in relation to any matter and in any form and for any period of time.[now go read post 3 of the sar thread on what info to put to ENSURE you get ALL the info you need - dx]

 

Is there another SAR thread to look at?

Now that I am free from Acenden after many years of pain I have sent them a SAR to calculate the charges that were added to my account over 15 years or so.

  Today I received a reply saying that they could not verify my identity as no signature was on the request to match with their records.

Do SAR’s need to be signed?

 

The letter also has the details of Kensington Mortgages as the data protection office which confused me as I was unaware that my mortgage was with Kensington.

I took the mortgage out with SPML so I would have thought that they would be the data handlers not Kensington.

 

Could anyone advise please.
