Thankyou for that, so even though in my letter they say they have checked records from that time and I was eligible and the premium would have paid out under sickness ( even though the sar says they don’t have any records).

Are the particulars the claimants statement or the documents I requested?
I assume I do nothing at this stage?
If what has been sent to me is all they have, I cant imagine its going to go far.
the ombudsman can force the pension probider to put you in the position you would have been if you hadnt taken their advice.
that is not the same as looking at missold pensions in a general sense, you have to have somthing concrete and i think you do. Your problem is the time that has passed hence asking what correspondece you ahve and how often do you raise things with the bank.
so they don't actually say what it was that you did wrong.
that is useful for you as you can argue there is no cause for action as they havent said what the supposed breach was.
for example they should say that the breach was an overstay of the prescribed time but they have been lazy and just said you owe the money because we say so.
Will this be a killer for their claim? unfortunately no but it can mean the judeg knocks 25% off for getting the paperwork substantially wrong but more likely it will add weight to your other arguments and they lose as a result of the judge prefering your evidence and the way you presented it.
