xxx PLEASE HELP xxx

 

  • Britannia mortgage with approx £10000 arrears
  • Have not paid mortgage since March 2019
  • Suspended Order of possession & money order granted by court in April 2016
  •  Have been told of their intention to apply for warrant to evict

I am working  full time  now  after a serious illness  and i made arrangement to pay in October 2019 but failed because of ill  heath ,  now SPML  are looking to apply to court for an eviction order.

What can i do  stop  this ? sorry i am very dyslexic an i find  this hard - so ashamed  sorry but please help

Have a read of the link I have provided above....your a little further on now because you have defaulted on the SPO...but you can still apply to stay the warrant an submit a further N244 application notice.The court will re-list the case and you will have the chance to present your case again to the court and to the Judge.

The others commenting on this thread have far more experience than me in this but just to put it out there. In terms of your illness, does the lender know? By that I mean a consultant/ doctors note listing the condition, medications, side effects. Plus the fact that you have Dyslexia. Diagnosed with a note explaining that you are in no position to defend yourself.

 

Surely a judge in a court would have to take this into account, would it be wise to obtain these, if you don't have them already? 

 

I am only commenting because a long while back my wife was seriously ill, we got behind on everything. We pretty much sent everyone a copy of what I am suggesting. Which, (temporarily) stopped matters in their tracks, and brought us some valuable time (years) to catch up.

 

It wasn't a mortgage lender though.

Did you make your proposal in writing and have they responded in writing?

Are you able to make the payment they want on Wednesday?

What have you offered to pay each month towards the arrears?

I have made the offer in writing and on a call. I offered my contract payment plus  £80.00 off the arrears . They will set up a payment plan once I have paid .. I have the payment and I will contact tomorrow as agreed.
