Smart ANPR PCN - Airport Pub, Manchester. now DR+ chasing

Hi, 

 

My OH received a parking charge notice from Smart Parking on the 29th November 2019. (ANPR Camera)

 

1. Date of infringement: 10/10/2019

2. Date on notice: 17/10/2019

3. Date received: 19/10/2019

4. No Schedule 4 not mentioned

5. Yes there is photographic evidence

6. The appeal was done via the smart parking website where she simply said she was not the driver. The driver's name was not mentioned.

7. Smart Parking

8. Airport Pub, Manchester.

 

They use BPA

 

She has had letters from Debt Recovery Plus asking for payment.

The last one being a final chance to pay, within which they say to contact them if you are not liable for the charge.

A reply was made on their website stating she was not the driver and could give the name of the driver if they get in touch.

That was done on 22nd Jan and am waiting for their reply.

 

I am away from a scanner until tuesday but please let me know what letters you would like to see.

Hi.

 

Please stop contacting them via the website, it could backfire on you.

 

Why have you offered to give the name of the driver?

 

People should be along to advise later.

I could be as bold to politely suggest this pub is within the boundary of what is considered airport land so is covered by their byelaws as its right next to the runway?

 

so stuff and all any private parking company can do by issuing speculative invoices for breaking some imaginary contract she entered into by pulling into a cap park with is private land?

 

please stop blindly contacting these fleecers and any powerless DCA that chases an imaginary debt.

as with all DCA's on ANY debt

they are NOT BAILIFFS

and have 

ZERO legal powers.

Unless someone here who knows more than I do thinks it's a good idea to name your brother, I wouldn't do it. This isn't the police, you aren't obliged to tell these people much at all and certainly not who was driving.

@dx100uk the land either side and behind the pub is airport land but the land the pub, carpark and beer garden occupies is owned by Robinson brewery. 

Unfortunately no bylaws, 🙁

the demand is for unauthoried parking so this is like any other demand for things like no stopping  etc inasmuch as you arent being offered terms for a parking event so you cant ever agree to terms. that makes the demand an unlawful penalty charge.

 

As far as contracts go it is like me suing you for not murdering my wife when clearly the only way of fulfilling that contract is to break the law so no lawful contract can be formed in the first place, hence no breach can occur.

The parking co's know this but honesty has never earnt them a penny so they have to bully and lie to get money out of people

The latest from this is an email that asks my OH to contact a telephone negotiator at Debt Recovery Plus.

 

I'm guessing this is not the best idea?

You're right, never ring them because they'll put pressure on you.

 

Only respond if you get a Letter Before Claim/Action or a court claim form. If one turns up, come back and talk to us again. :)

see what happens when you give them a method of harassing you for free?

block their email addy.

 

If the brother in law is willing to take part in some mischief then name him as the driver and give the address in Italy where he can be contacted.

 

they wont do this but if they sue you they will lose for a lack of cause for action against the named defendant.

 

What did you say in your appeal though as you shouldy say anything that contradicts that.
