i have recieved an offer from goldfish for the full amount of my claim however they state that it is a full and final settlement including any future claim against morgan stanley, morgan stanley bank international limited its trading names and any of its affiliates. it also mentions keeping the agreement confidential or the money will become returnable.

is this the norm or should i reject it especially as i dont know who its affiliates are? any help appreciated

25/07/06 sent 2nd request to alex lyon

1/08/06 recieved statements (NatWest)

4/08/06 sent S.A.R - (Subject Access Request) goldfish recorded delivery

4/08/06 sent SAR capital one recorded delivery

14/09/06 sent request for repayment letter and schedule of claim for charges goldfish

14/09/06 as above to capital one

21/09/06 recieved offer from capital one

I am assuming that you have a letter to sign and return. If this is the case, accept the money but cross out: in full and final settlement including any future claim against morgan stanley, morgan stanley bank international limited its trading names and any of its affiliates. it also mentions keeping the agreement confidential or the money will become returnable. Then return the letter.

Goldfish sent me a letter saying they would repay me in full providing i agreed to all their conditions, however from advise taken form this site i crossed out part of the conditions that i didnt agreed to i.e. any future claim against morgan stanly in accordance with the terms and conditions, costs and expenses, and any of its trading names and its affiliates.

i posted this back on the 14th of november my account still hasnt been credited with any money and i havent herd from them either.

Should i now write stating if i havent herd within 7 days then i will proceed with moneyclaim?:confused:

But do i send the letter giving them 7 days notice or just proceed with the moneyclaim? Sorry not trying to be thick just wont to get it right:)

You do not have to agree to any of the MS unfairly imposed conditions, any District Judge would take a very 'Dim View' of MS's attempts!

Just carry on with your Claim, meaning proceed with your moneyclaim.

MS/Goldfish are remaining silent, because they expect you to cave in, DONT!!

Just keep on going.

You can be sure that they will contact you again. They are just playing the game.
