Paypal Credit Debt £4000 - will they take me to court?

Hello all,

 

Ive had a look through the forum as much as I could but thought id post my situation anyway.

 

I have read alot of posts about Paypal and DCA that Paypal hire not being able to take you to court etc because they are in Luxemburg.

 

I have a debt with Paypal Credit for just over £4000 which I am unable to pay in my current situation and the minimum payments and late fees are just mounting up.

 

So could I just walk from this ?

Obviously I understand they will try calling me and sending me threatening letters etc,

but im happy to deal with that for awhile as long as I could wipe my hands with this debt...

 

Is it really true Paypal do not take people to court ever?

 

I am in the UK

 

I could deal with some letters to throw in the bin and some numbers to block, but I don't want court papers coming through the door...

no paypal credit is different

you signed a credit agreement 

it's only available in the uk

I believe Paypal credit is availble in other countries too.

what I mean is you signed an agreement regulated by the consumer credit act in the uk

So that gives Paypal the authority to take me to court if I don't pay their debt?

I digitaly signed their terms and conditions...but with them not being in the UK and off in Lux can I still walk away from it?

no ...you signed a UK consumer credit agreement..gov't by uk law.

 

the t&C's are merely paypal's T&C's in addition to the CCA act.

 

as far as I can see the financier of paypal credit is  paypal sarl 

though not a UK company, they are quite entitled to enforce the agreement signed by you under uk law.

 

what you have to realise here is that your case is different from most here, that either were the result of buyer/seller fraud or exploitation of the in/out balance transfer system to fund gambling. paypal gave you £4000 to spend against a legally binding agreement that you pay it back.

 

now just like any other uk creditor, it's very rare for them to do court thermselves

but

there would be nothing stopping them selling on the debt to a uk debt buyer (DCA) via a notice of assignment and them taking you to court.

 

now have we seen this happen yet...no.

Also, not sure if it’s the case for everyone but Paypal Credit never shows up on my CRA files.


We could do with some help from you.

Check all 3 Credit Ref Agencys.

This will default in its current state and you cant avoid that. But dont bury your head in the sand. 

 

Sit quiet for now - Let it go through the process - Come back if it gets sold to a DCA - But keep it in mind that this does have to be repaid.

Thanks for all your input, I can pay this back but im struggling - I may have to contact a debt relief agency. I wonder if they could help. Maybe cut the interest and fee's and just pay back the debt in my current situation would even help.

Do what myself?

 

I am actually on ESA and PIP so my income isn't t he best, but Paypal didn't mind giving me a 5K credit limit!
