    • Yes you can.....you appear to have a good understanding of the basic credit consumer law.....possibly impress the judge that you went it alone...plenty of Fast Track cases been fought and won by litigants here on CAG.   If you have the evidence...the argument....and the personality to convey .....go for it...think of the fees you will save not paying the barrister.
    • Hi FTMDave They initially requested £140 within 14 days. This has now gone to £182 after the initial debt collection firm took over (now back with CEL   The carpark had two options, pay-by-app and cash, we had n cash hence using the easier app. The app in the playstore has shocking reviews, im not the only one.   I wasnext going to get 'their hand' sent to me fromt he data controller, sending the following:   Dear Sir or Madam   Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )   Please supply the data about me that I am entitled to under data protection law  relating to myself. - All photos taken - all letters/emails sent and received, including any appeal correspondence earlier - A PDT machine record from 23/11/2019  of payments - A record of online payments made using the Google Playstore APP that day - all data held, all evidence they will rely on, and - a full copy of the PCN, NTK - a list of all PCNs outstanding against me and/or this VRN, and I will remind here that any claim must be for all PCNs, not several separate claims.   If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month. If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.   Yours faithfully
    • You need to read some more and then some.......costs are restricted in Small Claims Track....have a read of the above thread...same scenario...and its getting close to a hearing now....squeaky bum time for them.
    • OK, we can help you.   A couple of questions first.  You blanked out the amount they are claiming.  Can you tell us?  I bet they have added Unicorn Food Tax to their claim.   Also, can you remember if this was pay-by-app-only car park, or if there were other payment methods?
    • ok if you don't get your from the court tomorrow there are blanks here to send   let see. no immediate rush.
  • Our picks

    • Hi @BankFodder
Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.

I opted for mediation, and it played out very similarly to other people's experiences.

In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.

In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.

In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.

To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.

So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Many thanks, stay safe and have a good Christmas!

Boris 'the Liar' speech translated

'Some months ago we told you you had to stay at home to protect the NHS, and you understood that our decimation of NHS funding meant that all other NHS work had to stop, and its resourses were severely limited.

Now I'm sure some foolish people thought that was to allow time for the underfunding and the under staffing of the NHS to be reversed.

But clearly, as the majority of you did as requested, and suffered and died quietly at home and in homes to a level we could barely believe, clearly it meant that the money we might have been forced to spend on the NHS could be retargetted to our mates like serco - so of course we did.

Now 6 months on, with the NHS staff exhausted and at breaking point,  our pals simply cant be expected to actually deliver on the ridiculous claims, we are simply trying the same scam again on you idiots to free up even more debt generated money to route to our pals tax haven bank accounts which your children, childrens children unto the 7th generation can pay back.

So, with PPE money allocated to companies we chose who clearly needed the money, and debt at record levels I'm sure you will all realise that again everyone else must not mingle, and must stay at home wherever possible, so the children can go and mingle in schools in full sized classes and allow the virus to spread there and get back to you smart arse plebs locked in at home who have managed to avoid it so far.

and I'm sure you will all understand its absolutely crucial that neither you or your family -  especially children - should waste essential resources and apply for tests until you are showing clear covid symptoms and we know you have it.

Thank you suckers.
Bojo

I’m currently on day 9 of mild symptoms  Starting about 5 days after My daughter had symptoms and subsequently tested positive.  she’s well over it now.   From my point of view I’ve had far W

It isn't realistic to lock all those with underlying conditions and over 70s in their homes for the rest of the year   It would have to be properly organised. We have various family members

I think Johnson is now under assault on three (perhaps 4) fronts

1. The remnants of the real tories who are challenging his incompetence and reckless wasting of money with only a few personally profiting from it while even traditional Tory plebs are suffering

2. The ERG/populist nastiest of the nasty party who got him in, who think he isnt routing enough of the money to them and who think the p[lebs should be out earniung them money until they die

3. A resurgent labour party under a competent leader

4 (perhaps) the return of the Jewish to the labour fold now Corbyn has received a well needed slap.

...

5 - the voters who only voted for him because they literally thought he had promised to:

'Vote for me and on October 31st and we (the Johnsonites, ERG and Brexiters) would jump off a cliff do or  die

- yet here we are, another Oct 31st has passed and the git hasn't taken his opo's and jumped off a cliff.

There's the NRG as well, TJ. What a shame for Boris.

I had included them in option 2 if their 'leaders' are anything to go by HB

Could be wrong as I haven't checked every one individually, but didn't every single one of them vote to block feeding hungry kids?

The vast majority certainly did - including the leadership

- the majority of those hungry kids being in the North?

Disenfranchised johnsonite opportunists ..

Esther Mcvay ('nuff ssaid), Thick as mince do nowt Davies, and led by the man who has already totally sold out and utterly failed 'the Northern Powerhouse' as its minister - Jake berry

Not looking like anything other than another ERG faction using whatever for their own ends to me .. whatever the rank file in it might think or not.

Just what we need, Farage is relaunching the Brexit Party under a new name and with an anti-lockdown agenda. This is going to cause further division.

And nobody knows where the money to back him is coming from.

According to the Guardian, the tests that Johnson wants to send out in a huge operation for people to test themselves aren't designed for that purpose. 20 million of them.

https://www.theguardian.com/world/2020/nov/02/doubts-over-rapid-turnaround-covid-tests-pledged-by-johnson

I've not looked into detail which test is which and there are a number of lateral flow tests which use slightly different 'forms

but the more appropriate ones are supposed to be like a pregnancy test and about 93% accurate

they 'magnify' anything searched for that is found in the body, so if the magnification is slightly off, orthe viral load balance (where it congregates) in the body is off so is the test

As they magnify what they find - they are also very 'level of infection' specific

ie

Magnify too much - everyone shows positive

Magnify not enough - no-one tests positive

Too early or too late in the virus life infection cycle - false negative or positive when on the mend

Particular person has lower viral load in 'wherever/whatever tested fro any reason - false negative

Yup, problem is the maths shows the NHS failing by Christmas. So the ‘herd’ could be anybody who has a heart attack, car crash, infection etc.

I swear do people who believe in this really think anything through logically?

Good news is a snap You Gov poll shows high public support for lockdown at 73%

David Lammy tweeted this earlier about Farage's new party.

Nigel Farage’s EU salary ran out, Trump is unlikely to remain President & it’s too cold to shout at refugees from Dover.

So now he seeks votes risking lives by opposing public health measures in a pandemic.

There has never been a more shameless opportunist in British politics.

Yup, I wonder if he truly believes that we should just let Covid do it’s work, unchallenged.

This is not a joke, my daughter was ill for 1 day , I had mild symptoms, fevers and chills and headaches for 12 days, now my wife has come down with symptoms much more like the flu than I did. Test on it’s way.

The way it affects everyone so differently is terrifying. The way it takes hold in a house is terrifying. And it would seem like in the end to get this controlled Schools are going to have to close .

Yup, I went for a socially isolated run and managed 4 miles so I’m guessing Covid is done with me.

Thanks for the best wishes, I’m just keeping an eye on it, into the second week for her. Luckily hospitals are not yet under so much pressure in this area, If it’s needed.

The figures indicate as many as 500,000 deaths if covid was allowed to run its course

- and that is largely based on the Virus not significantly mutating while jumping among millions, many of whom would already be infected, and that there was significant immunity generated in the majority of the population

- both of those assumptions would be unjustified and stupid assumptions of truly epic proportions

Without a genuine world class (doesn't need to be world beating) test system which doesn't require you to be showing infected symptoms before you are tested - as its too late then, PLUS a quality follow up trace and test system,

.. neither of which we have, even the current proposed lockdown isn't likely to cut it (although it will reduce the spread unquestionably)

If slovakia manages to do this, why can't or haven't we?

This lockdown will carry on for months, and schools will end up closing , its hard to see how they won’t.

Politicians like IDS, Desmond Swayne and opportunists like Farage don’t seem to understand that 1 million people at the same time needing hospital treatment will bring the economy to a grinding standstill far worse than any lockdown could.

I don’t understand if they are stupid or they simply don’t care.

The chair of the UK's vaccine task force showed “official sensitive” government documents to a $200-a-head event for elite US venture capitalists last week

Bingham combines the role (chair of the UK's vaccine task force ) with her job as managing director of SV Health Investors, a private equity firm
Like Dido Harding, she is married to a Conservative MP: Treasury Minister Jesse Norman.

They don't even attempt to hide these antics.  In their heads it's acceptable.

The Good Law Project and Runnymede Trust have launched legal proceedings against the government’s repeated appointment of individuals who are connected with senior members of the Conservative Party – without advertising these roles.

Good on them for trying but we all know where this will end up - absolutely nowhere.
