    • Probably because the claimant refused mediation Means nothing   An SA is a simple brief statement stating obvious facts of the case as the defendant now sees it taking into account their defence and if anything has actually moved forward since filing it.   As far i can see, the claimant has failed to serve any proof of debt, namely bills, etc etc   Pers health issues are not typically relevant. But in this case its worth a mention??
    • I could be wrong but if they are chasing you as the executor and the estate is settled in full then the debt is unenforceable and has 'died with the debtor'.   I had a similar debacle with a private health care company  who insisted that I was liable for their warden controlled facility on my late mum's property when once her accounts were closed and they didn't get that month's payments, started writing to me as executor saying that the debt and on going charges were now my responsibility. I gave them short shrift and told them to take a hike and after many threatening letters I told my solicitor to make one payment to them for the cost of 3 months service after the date of death, I told them they were lucky to get that and they wouldn't get anything else.   They kicked off and sent a few more letters which I refused to respond to and then they went away realizing they weren't going to mug me for any more money.
    • I hear what you say.   What does Theresa need to do, and pull together as a basis for the skeleton arguement? Proof of mental health assessment from her GP? Reference that part of the alleged debt is now statute barred? Lack of requested information from SW&S?   scmreferrals@justice. sent her an email 11th March 2020 offering mediation "A telephone mediation session of up to one hour is available to you on 01/04/2020 between 11.45 and 17.30." THEN: Another email from scmferrals was then sent within 2minutes withdrawing this offer of mediation.   Aside from the above. Would an SAR be of any use?
    • That advice is all good.  Thanks for everyone's help. its appreciated

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.

We had a 10yr  finance contract for a boiler fitted July 2015.

After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.

It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.

A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?

After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.

The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty.

You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.

I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.

As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.

If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.

They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.

If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.

The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.

They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.

Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

It isn't realistic to lock all those with underlying conditions and over 70s in their homes for the rest of the year   It would have to be properly organised. We have various family members

The other ones to worry about are Palantir who are data-mining NHS records, I've read, and are now being paid £1m to do it.

Had a laptop for a month, but required to work from office.   First day working from home as a trial and I can see why people like it.   Two minutes commute to work.  But supply of coffee nearer as well a food supplies, so it could become unhealthy.   The plan is to do a mixture of office and home based working.

Virus numbers looking worrying and a full lockdown quite possible.  So if this happens, then I can see most people wanting to work from home all of the time.  But I work in the public sector, so our health and safety appears to be decided by Downing Street.

We could do with some help from you.

Not just coffee and food

The loss of the movement/exercise (however stressful) in travel to work is a MAJOR issue.

Heres a little test for cjregg spicer as he claims the rule of 6 is straightforward

As he says he is ignoring me - clearly to continue avoiding answering these straight forward sort of challenges to his regurgitated handcockian and Boris the Liar claims delivered from his white-wash house,

I would suggest anyone just fires this at him rather than rise to his continuous bait. He's answered few enough questions fired at him regarding his effort and support free sound bites.

A simple social grouping of 6 households, an entirely normal mix of family and friends, who normally socialise and support each other (fetching/taking kids to/from school, looking after kids and watching out for grandparent while rest of family working etc etc)

Working age adults - Some at workplace, one on furlow, some home working.

Kids are in various years/bubbles at 2 local schools

Most would put CofE on forms religeon wise, less than half would put none.

A number are members of social/sporting clubs which allow guests

1 with 3 members

2 with 4 members

1 with 5 members

1 with 6 members (including a grandparent still active and in fairly good health age and medications considered)

1 with 7 members

As cjregg claims its all straightforward and doesn't change

Where, when, how and why can or cant some or all of them meet?

IF it gets clarified quickly.  How long did it take for all those charges to be dropped which had been brought under the new legislation, not one of which was legit.  The one case which could have stuck because it was someone deliberately travelling whilst infected was Cummings but excuses were made for him whilst others were wrongly charged.

Why is the public being blamed for the increase in infection rate when Boris was adamant that people should get back to work?  The demographic of those infected this time round includes a significant number of relatively young women, the very people in the kind of jobs which expose them to a high viral load - underpaid and undervalued jobs in the main. How blameworthy are they?  MPs did a pretty good job of spreading it around at start but nobody suggested it was their own fault.

I'm not sure what what dropped charges you mean but whether measures are just recommendations, rules or enforceable laws, surely people should be complying regardless shouldn't they?

Where did the government 'blame' the public? Matt Hancock said ''the rise in cases in Bolton is partly due to socialising by people in their 20s and 30s, we know this from contact tracing''. That's not attributing blame, it's identifying a cause. But here on the bitch-fest that is this thread, facts don't seem to matter much.

Heres the sort of justifications Handcock uses for his actions and blaming the victims of his failures:

"I've even heard stories of people saying 'I'm going on holiday next week therefore I'm going to go get a test'. No. That's not what the testing system is there for."

Not science, not even claims of personal experience,

Nothing more than a claim of hearsay regarding a few people allegedly wanting to get tested before they go somewhere

- actually seems pretty responsible to me to want to be sure you aren't going to spread COVID

- shame that Handcocks actually claimed test capacity is a vastly overstated pile of lies

Oh, and whats another Handcockian excuse?

'You are getting all the 'in contact' children tested when theres a positive case ..

... Its waisting tests ... on children who have been exposed eh?

In June Boris Johnson told the country it was our patriotic duty to go to the pub (and spread the coronavirus):

that having been an effective message, the government is now mandating the early closure of pubs and restaurants in what is being called a “curfew”, as though it were the public and not the government who were a bunch of unruly children.

Yes, quite distinct difference

Scotlands first minister does seem to quite clearly demonstrate she understands the reasons, the personal situations and have real sympathy in stark contrast to Johnson the Liar and Handcock

and I note MP's are still getting away with breaking rules when they should be both leading by, and punished as examples

Despite clearly being shown sat reading something, with more reading matter readily available, Wilson claims he only 'momentarily took his mask off to answer a telephone call and 'denied witness claims he did not wear a mask for the entirety of his tube journey from Westminster to Heathrow

Wilson has repeatedly railed against face masks 'muzzles' and declared himself being reported as “like East Germany under the Stasi”

Interesting that honourable MP's and even some advisors have resigned for less.. Nicola Sturgeons' for example.

Latest (available) government testing figures for 10-september-to-16-september (10 days ago)

"587,173 people were newly tested, consistent with the previous week but an increase of 30% compared to the end of August."

*** Which works out to UNDER 84,000 people a day being tested that appears to be collapsing Handcock, Dido and Sercos Trace-a-test

- 30% up from only around 65,000 People tested a day at the end of August

.. for a claimed 240,000-300,000 'capacity which has and is collapsing when even a 3x increase in people being tested should be within the long and still claimed 'capacity

Given the lack of newer figures - they cant be anything to shout about eh?

So my prior estimates of around 60,000 climbing more recently to 75,000 were over estimates; but right in the ball park; and only exceeded in the last few weeks or so.

This is from the Guardian live feed at 13.40.

England’s troubled and much-delayed NHS Covid app does not accept test results processed in the country’s government-run laboratories, hospitals or as part of an official survey, officials have admitted.

The app’s official account said on Twitter it could not link to test results taken in Public Health England (PHE) laboratories, at the National Health Service (NHS) or as part of a survey run by the Office for National Statistics (ONS).

So what is the point?

+ I was looking the other day

The data processors for the app:

  1. NHS Professionals, (which is providing registered medical professionals to help contact people who test positive for coronavirus to identify their close contacts (NOT #RealNHS and since making a profit from the #RealNHS the Tories have been trying to sell off cheap to the private sector))
  2. Serco UK, which is providing staff to call the contacts of people who test positive and provide guidance on self-isolation
  3. SITEL Group, which is also providing staff to call the contacts of people who test positive and provide guidance on self-isolation
  4. NHS Business Services Authority, which is sending text messages and developing management information reports
  5. Amazon Web Services, which is providing the secure UK-based storage location for the contact-tracing service information
  6. The Cabinet Office, which provides the GOV.UK Notify service used to send contact-tracing texts and emails
  7. Kainos, which is assisting with the operation of the contact-tracing website system

https://contact-tracing.phe.gov.uk/help/privacy-notice

Of course, some of those are 'registered' and host services in the USA so are beholden to USA data release rules.
