    • I think it would be a mistake not to respond. Although the circumstances were pretty different, we are dealing with a case elsewhere on this forum where somebody decided not to respond to an email and they ended up in subsequent proceedings paying quite a heavy bill of costs. I thought it was unfair and rather Draconian decision of the judge – but it shows that it can happen. It's clear that you will have to accept the money is satisfaction of judgement. However if you want to play them a bit then I suggest  
    • I received the first signs of life from Shell Energy's "legal counsel" regarding the 1st claim and default judgement awarded against them.   I have attached a redacted copy of the letter where they indicate they look forward to receiveing a letter of confirmation.   I am confident I know why they have sent this request and more importantly how they intend to use any response.   I have prepared two options.   1. Ignore their letter (This is probably the best option).   2. Reply succinctly.     Shell Energy - Warrant of Control Response - Redacted.pdf
    • I found an old defence I used and tweaked a bit. Unfortunately I think I messed up in not asking for a statement in my cpr, while it wasnt referred to in the poc it does have the amount. There were no paragraphs and it looks like it was done on a phone or even an excel import??. I dont know if not requesting the cpr means I cant ask for proof of how they got the amount?   Is that enough about the lack of account details?, I mean my cabot ref is at the top of the page but 100% no aqua account number on here. The Claimant has failed to provide any evidence of the Agreement/Assignment/Default notice or Termination requested by CPR 31. 14, and will shortly be in default of my section 78 request, therefore the Claimant is put to strict proof to:   (a) show how the Defendant has entered into an agreement and; (b) show and evidence the breach and service of a Default Notice pursuant to sec 87(1) CCA1974 on which the Termination referred to relies upon. (c) show how the Defendant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim;   5. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed.   6. On the 17th of November I requested to The Claimants Solicitors, Mortimer Clarke by way of a CPR 31.14 copies of the documents referred to within the Claimants particulars to establish what the claim is for. Mortimer Clarke have failed to fulfill my CPR 31:14 request.   7. On the 16th of November I made a section 78 legal request to the claimant for a copy of the Consumer Credit Agreement. The claimant has as of of 06/12/21 failed to comply.   8. By reason of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.  
    • Hi Dixon,   If you don't mind, I'm ignoring the CCJ for the moment.   I'm more interested in what you last said to the police about their failure to investigate the fraud against you commited by FTR Ltd and O'Hara.   If you don't want to post it on-thread, send it to me by PM.
    • ok not to put too finer point on the 'silly' mistake ( as in terms of you are a 'litigant in person' - joe public against the 'system') you made on your claim, there are guides on the same website about raising a claim and how to do it properly, but IMHO there should also be LiP leeway regarding this.   did you seek or read any help, as getting the correct entity to sue is quite important, the example you relate too would not be an issue, but suing a corporate entity is, they have lots of money and clever legal eagles.   i have no doubt that, by whatever way, should you rectify this error , you would be successful mind.   on another issue, have you written to apple uk retail offering to mutually settle this if they pay the price of the device or replace it and call it quits?   i will guess this is all you really wanted at the start and now at the end of the day.?   would you seriously lose out money wise if this were agreed?

I have mixed feelings about this HB

 

Some GP's practices certainly need a kick up the jacksie .. rather than a carrot - we have one locally

Some GP practices really need more funding and more doctors rather than any kicking - we have a couple of those locally

 

BUT - I have no doubts whatsoever that the populists, even the more remnant Toryish ones like Javid, wont do anything that addresses the real problems for the bucketloads of taxpayer money they will squander .. unaccountably.

Absolutely not.  Where I'm seeing a lack of masks is in town, not in this conservative country backwater.  Typical example - 27/9, tube from Leicester Square to King's Cross at around 11pm I'd generously estimate around 50% compliance with mask wearing.  There's nothing special about this particular date/time/route, it's that I can recall it with some accuracy because I made a particular train out of St Pancras.  I see nothing different at other times and nobody says a thing.  That's on TFL where mask wearing is still supposedly mandatory.

50% mask wearing on transport here in a English relative 'backwater' (reasonably large town) is a pipe dream, as is anything more than 25% (at best) mask wearing in supermarkets. Our covid rate is quite high too.

.. All the other UK+NI nations have stricter and more sensible (IMO) and scientifically supported stance.

So do you think the other nations are right?

 

and do you think vaccine-less and mask-less people should be on public transport or in extended close contact with our children, elderly and sick ?

According to several people on Twitter, the UN seem to have read the joint select committee report on the UK's handling of the pandemic and withdrawn the job offer.

Molnupiravir, an antiviral medication made by Merck, could herald a not-too-distant future when a simple pill could keep people infected with the coronavirus from dying or falling severely ill. The drug is easy to distribute and can be taken at home. Trial results showed it halved the risk of hospitalization and death among high-risk people early in their infections.

Unlike the manufacturers of some Covid vaccines, Merck will allow generic manufacturers in India to sell the pills at a far lower price in more than 100 poorer countries. Most nations in sub-Saharan Africa, where vaccination rates are as low as 3 percent, are covered by the deal. The company has also applied for emergency-use authorization from the F.D.A.

Drug-access advocates say the Merck licensing deal is an encouraging start but only a small step toward equity. It is unclear how much of the generic product will be available next year, and the agreements leave out many undervaccinated nations, such as Ukraine, that have been hit hard by Covid.

Indeed. I was just thinking 'Here we go again'. NHS trusts are saying they have problems and want to move to Plan B, Indie Sage scientists are saying things need to change. But HMG isn't listening and says everything's fine. 

 

Meanwhile Chris Whitty has at least stressed the importance of masks, ventilation and so on.

The Good Law Project has come into possession of documents on the discharge of patients from hospitals into care homes without testing last year, provision of PPE and more.

 

It's pretty depressing and the worst thing is that they could probably have tested people beforehand, rather than putting care home residents and staff at risk. Awful.

Well, belatedly they're pushing vaccinations for over-12s and boosters but late. If kids had been jabbed before schools started back, arguably far fewer cases would have been spread that way.

 

Why do so many people not have invites for their boosters yet, when they qualify?

Amid rising numbers of cases, the British government has rejected calls to reimpose coronavirus restrictions, while warning that such measures might be needed if the rollout of vaccine booster shots fails to contain the worsening situation. Britain, which administered vaccines early, is now reporting one of the highest rates of new cases in the world as the vaccines’ effectiveness wanes.

“We will do what it takes to make sure that this pressure does not become unsustainable, and we won’t allow the N.H.S. to become overwhelmed,” said Sajid Javid, the health secretary, referring to Britain’s National Health Service, which is already under pressure. He warned that new cases could surge to 100,000 a day.

 

The British government’s contingency plan would reimpose some restrictions that were scrapped in England in July, including mask-wearing rules and urging people to work from home. Those visiting nightclubs and other venues could be required to show proof of their vaccination status or of a recent negative test.

 

Analysis: Experts believe cases in Britain are rising because large numbers of children are unvaccinated and schools do not require face coverings. Mask wearing is less prevalent than in some other parts of Europe, where masks are often required indoors and where cases per capita are much lower.

Data: Britain has reported over 40,000 new cases for seven consecutive days, and 869 patients were admitted to hospitals on Saturday. The daily death toll rose to 223 on Tuesday, the highest number since March

REAL breaking news

Boris Johnson has blamed the slow booster jab rollout on people not coming forward for their vaccines.

Speaking from Northern Ireland, the prime minister insisted there was adequate supply. “It’s a demand issue. We really urge people to come and do it,” he said.

His remarks come after Labour claimed two million eligible people are yet to receive an invitation for their booster doses.

 

Those who what loose women will have seen them (including Street Porter) stating they want the booster but cant find anywhere to get one anywhere local to them, and sites saying they can't just cant get the people trained people to do the jabs as the volunteers that did it last time are all back at work

Despite the rapid start of vaccinating the population, the UK now has the 13th highest vaccination rate in Europe and the government has received criticism for the (lack of) speed of its booster program and the (lack of) availability of vaccines for 12-17 year olds.
