    • I'm still pondering/ trying to find docs re the above issue. Moving on - same saga; different issue I'm trying to understand what I can do: The lender/ mortgagee-in-possession has a claim v me for alleged debt. But the debt has only been incurred due to them failing to sell property in >5y. I'm fighting them on this.   I've been trying to get an order for sale for 2y.  I got it legally added into my counterclaim - but that will only be dealt with at trial.  This is really frustrating. The otherside's lawyers made an application to adjourn trial for a few more months - allegedly wanting to try sort some kind of settlement with me and to use the stay to sell.  At the hearing I asked Judge to expedite the order for sale. I pointed out they need a court-imposed deadline or this adjournment is just another time wasting tactic (with interest still accruing) as they have no buyer.  But the judge said he could legally only deal with the order at trial. The otherside don't want to be forced to sell the property.. Disclosure has presented so many emails which prove they want to keep it. I raised some points with the judge including misconduct of the receiver. The judge suggested I may have a separate claim against the receiver?   On this point - earlier paid-for lawyers said my counterclaim should be directed at the lender for interference with the receiver and the lender should be held responsible for the receiver's actions/ inactions.   I don't clearly understand that, but their legal advice was something to do with the role a receiver has acting as an agent for a borrower which makes it hard for a borrower to make a claim against a receiver ???.  However the judge's comment has got me thinking.  He made it clear the current claim is lender v me - it's not receiver v me.  Yet it is the receiver who is appointed to sell the property. (The receiver is mentioned/ involved in my counterclaim only from the lender collusion/ interference perspective).  So would I be able to make a separate application for an order for sale against the receiver?  Disclosure shows receiver has constantly rejected offers. He gave a contract to one buyer 4y ago. But colluded with the lender's lawyer to withdraw the contract after 2w to instead give it to the ceo of the lender (his own ltd co) (using same lawyer).  Emails show it was their joint strategy for lender/ ceo to keep the property.  The receiver didn't put the ceo under any pressure to exchange quickly.  After 1 month they all colluded again to follow a very destructive path - to gut the property.  My account was apparently switched into a "different fund" to "enable them to do works" (probably something to do with the ceo as he switched his ltd co accountant to in-house).   Interestingly the receiver told lender not to incur significant works costs and to hold interest.  The costs were huge (added to my account) and interest was not held.   The receiver rejected a good offer put forward by me 1.5y ago.  And he rejected a high offer 1y ago - to the dismay of the agent.  Would reasons like this be good enough to make a separate application to the court against the receiver for an order for sale ??  Or due to the main proceedings and/or the weird relationship a borrower has with a receiver I cannot ?

    • You could send an SAR to DCbl on the pretext that you are going for a breach of your GDPR . They should then send the purported letter of discontinuance which may show why it ended up in Gloucester and see if you can get your  costs back on the day. It obviously won't be much but  at least perhaps a small recompense for your wasted day. Not exactly wasted since you had a great win  albeit much sweeter if you had beat them in Court. But a win is a win so well done. We will miss you as it has been almost two years since you first started out on this mission. { I would n't be surprised if the wrong Court was down to DCBL}. I see you said "till the next time" but I am guessing you will be avoiding private patrolled car parks for a while.🙂

You came here at the very last minute and the regulars - all unpaid volunteers - sweated blood trying to get an acceptable Witness Statement prepared in an extremely short time. The least you could have done is tell us how the hearing went, information invaluable for future users. Evidently not.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I read an article recently about an NHS worker who paid £300 for a specialised heart scan, because standard checks did not reveal anything.  They had been suffering from a number of symptoms reported for long Covid. 

 

The addition heart scan revealed reduced heart function.

I have seen studies (linked here) that vaccination reduces both the chance of getting and the severity and duration if you get it - of 'long covid.

 

What greatly concerns me is that we are just getting hints of vaccines targeting the delta version, when we are already at 3rd generation Omicron.

We should be at a stage where cocktails of vaccines (like for flu) are available and quickly updated. Yes i know that flu strains are 'more static/stable' than COVID, but the world of infections is moving on - and so must we to simply keep up.

 

Still expecting a real sh**storm of a recombination/mutation that mixes with something else really nasty and the resultant being something like truly airborn ebola/covid mix that will spread like wildfire among dense human populations and transport systems.

 

I really do at least half believe some of the conspiracy theories that certain 'elite' want that as a population reduction scheme while they are locked away safe - and the simple fact that should Johnson get it - he wont be waiting 8 hours for an ambulance and then lying in it for another 8 hours before he spends a few days on a stretcher in a corridor ....

... he'll be VIP'd straight into a private room with 2 nurses all to himself ... again.

Until then, what is your point about older people and anti-inflammatory medicines?

or are you just quoting learned articles at random in the hope that occasionally you’ll either “get lucky” with a comment, or that you’ll gull someone into thinking you actually understand the cytokine / interleukin / inflammasome pathways…..


The utility of steroids (dexamethasone) for in-patients needing oxygen has been demonstrated by the RECOVERY trial.

I can’t see where this has been analysed on a sub-group basis for older people on anti-inflammatory meds : are you suggesting the trial has “missed a trick”?

 

What is your feeling on which interleukin needs to be targeted? And should it be upregulated or downregulated?

 

More to the point (since I don’t expect an answer that shows any degree of understanding, if you answer at all) :

 

What is your point, rather than just posting journal articles at random!

Far-UVC disinfection works in real rooms

Real-world tests confirm that short-wavelength ultraviolet light, known as far-UVC, can disinfect air without harming people. Researchers found that far-UVC lamps effectively wiped out airborne Staphylococcus aureus bacteria in a room-sized chamber. Even when the bacteria were continuously released into the room, the lamps — combined with typical ventilation of around three air changes per hour — reduced the amount in the room by 92%, equivalent to 35 air changes per hour. Far-UVC light has long shown promise against airborne pathogens — including SARS-CoV-2 — in the laboratory. And, unlike other forms of UV light, it doesn’t damage human skin or eyes, or cause cancer.

it works in theory.

it works in practice, in limited and specific circumstances.

 

it FAILS in practice if you don’t know what you are doing. Shadows. Exposure from the contaminated items while setting up the decontamination run.

 

So, the item(s) must be physically clean.

Dirt? Creates a shadow, that the organism can be protected from the UVC.

 

Irregular shape of item to be disinfected?

risk of shadows, shadows -> organism can be protected from the UVC.

 

When SARS-CoV first ‘hit’, there were sites using UVC to decontaminate FFP3 masks for re-use (as the masks were in such short supply). The set up was designed by engineers with input from Infection Prevention teams, so that the limitations were mitigated, and a rig that “worked” was created.

 

The team involved published a paper on this.

 

I was asked by a friend (who was / is “extremely clinically vulnerable”) about UVC, for him to treat the shopping he was having delivered that couldn’t be left to stand for 48 hours. I sent him the link to the paper.

Then again, he is also a scientist and has an engineering focus too, while he could source / build a UVC rig, and would understand the uses, risks, benefits and limitations of its use, including correct use of PPE while handling the items for decontamination.

 

I wouldn’t try it for myself : how sure am I that the UV is safe? (Even if it is focused on UVC, am I sure there is no UV-B or UV-A)

For “Joe Q. Public” : how sure are you they’d get around the cleaning / shadows? (Or risk being exposed while cleaning?)

it might give them a false sense of security ……

Which airlines have been most affected?

Airlines including British Airways and easyJet announced a string of flight cancellations shortly before Easter, as rising coronavirus cases led to high levels of staff absences.

Tui also made several last-minute cancellations over the weekend from airports including Gatwick, Birmingham and Bristol, as a result of “operational and supply chain issues”.

Real issues are even more than that

Apparently although flight staff were furloughed, baggage handlers weren't .. apparently few want the jobs as reports are that the UK cost of living crisis means many expect collapse of holiday orders again

 

Reports of people queuing hours for flights then they are cancelled, or if they aren't the baggage doesn't get onto the plane with them ..

 

Horrendous.

"R" number for covid infections is now over 1, mainly due to the K4 asnd K5 omicron variants. Hospitalisations are on the rise,

and this is during summer weather ... and with reinfections occuring

 

On the plus side, Moderna variant vaccine(s) are looking promising, including against the K4/5 variants.

Covid

 

The new BA.4 and BA.5 Covid variants are beginning to bite, as covid infections jumped 43 per cent after the jubilee weekend. Meanwhile hospitalisations jumped by 43 per cent in a week on Tuesday.

 

Monkeypox

 

National concern over monkeypox continues to grow as 793 cases have been recorded and the UK Health Security Agency have decided to pre-emptively offer vaccines to gay, bisexual and men who have sex with men, who are seen to be at higher risk.

 

Polio

 

A national incident has been declared after poliovirus was detected in wastewater in London.

 

The virus, which can cause paralysis in rare cases, was identified in sewage samples taken from the capital between February and May 2022, according to the UK Health Security Agency.

 

UKHSA said it was “likely” there has been spread of a vaccine-derived poliovirus type 2 (VDPV2) between closely linked people in North-East London, with infected individuals believed to be shedding the virus in their faeces. So far, no suspected cases have been reported or confirmed.
