    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Surely you are aware that is commonly because people either die or become resistant (through milder infections or more recently inoculation),

sometimes the virus/infection dies out through lack of transmission if its blocked or kills all the hosts it can access.

 

The cold/flu is not so dangerous generally because its weeded out the more susceptible over centuries and we have better medication

- but still had a damn good go as recently as a hundred years ago.

 

Theres enough  compelling evidence that the Delta was more virulent (transmission and effects) and that the Omicron is more again .. each not a whole order of magnitude, but a noticeable shift. That effective vaccines were quickly generated has been a godsend ... so far. We may be squandering that.

 

There have been a lot of Cov mutations that weren't - but it keeps effectively mutating at the tail end of previous effective mutations - which makes it extraordinarily dangerous.

There were indications of this early in its life and when it was first mutating, hence the title of the thread.

 

You are deluded if you think this is anything close to over.

Especially when you have a total Piers Morgan in charge who doesn't even require LFT's before people come into the country, or lets his pals charge astronomical sums when he does require it.

and not only allows, but encourages mask refusal - which I think is the stupidest and most dangerous of all

Perhaps for perspective, consider that if a time traveler took a spray can full of a mix of modern pretty bog standard, unpleasant but nothing special flu and cold and sprayed it on a corner of London or Bristol in 1775, whether you think it would be less deadly or would cause utter devastation across the land?

Thats what I thought to  HB, but I'm seeing reports that these really must have come in positive (which is why I flagged I must be wrong)

I truly hope that I am or have at least misunderstood in some way

 

First  examples (so far) of Omicron cases seems to have pushed back into October in Southern Africa (on retesting samples)

I could be that Omicron infects and spreads in the body quicker .. which might tie in with other things I'm seeing

Fake/incompetent tests is another option aka Immensa

 

Sorry HB I think I misread your post, the point I was making is that people should be (and I thought they were) tested immediately before a flight and again 2 days after arrival

A negative 20 minute LFT immediately before boarding seems the proper point to me

 

Not left the country myself this year.

I've had the moderna booster, with zero side effects so far.

Booked Jab handled professionally and very competently by the different place I went to. They are turning away people who dont have a booking.

Well I attended local walk-in vaccination centre this afternoon.  Had Pfizer booster in my left arm and a flu vaccine in my right arm.  Earlier in the year I had 2 doses of AZ.

 

So far so good.

There was about 40 people in a queue and those who had appointments went in before the walk-in session started.

 

And the walk in session started at 3pm and I was out of the centre after a 5 minute sit down by 3.10pm.   After people had the jabs, they asked them to sit down for 5 mins, just in case they had a quick reaction.

 

Very efficiently run.   Some of the people had booked elsewhere and had decided to attend the walk-in centre, rather than wait for their booked appointments which were weeks away.

Any idea why they would open a walk in at an appointment center rather than offer more appointments?

 

Not sure how many people dont turn up for appointments - but they could have the last hour allocated for any available shots/time due to quick processing or failed appointments - is that what they did?

Going for my Flu Jab on Monday the 6th, never had one before, they say I "may" be offered a Booster at the same time.

I hope I get the Booster as never been too fussed about the Flu Jab.

 

Been informed at work we have had our NHS Covid runs extended until at lease July 2022, which is great for the guys who are on 3 month rolling contracts.

Any advice I give is honest and in good faith.:)

@maroondevo52 what appears to be happening, is that the companies arranging vaccinations have been provided with bulk supplies of both flu and covid boosters. So the staff doing the vaccinations have trays with both ready to go into arms.

SALE OF THE CENTURY:

The government’s plans to sell off the UK’s vaccine manufacturing plant will leave the country vulnerable to emerging Covid variants ahead, the head of the centre behind the Oxford jab has warned.

 

Professor Adrian Hill told The Independent that the sale of the Vaccine Manufacturing Innovation Centre (VMIC) in Harwell was like “having been in a terrible war and you suddenly cut your defence budget substantially”.

 

Labour’s Wes Streeting, the new shadow health secretary, said it “would be unbelievably short-sighted and complacent” to sell off VMIC with a pandemic still raging. Meanwhile, concern mounts over the slow rollout of booster jabs. Data shows at least 300,000 housebound people haven’t yet had their booster, according to The Telegraph.

Early reports suggest Omicron may be less severe

The Omicron variant spreads quickly, but the resulting infection may be less severe than other forms of the coronavirus. Researchers in South Africa said that their Covid-19 wards were almost unrecognizable from previous phases of the pandemic, with few patients on oxygen machines.

 

 

Scientists cautioned against placing too much stock in either the potential good news of less severity

 

By the numbers: Of the 166 patients with the coronavirus admitted from Nov. 14 to Nov. 29 to the hospital complex, the average stay was 2.8 days, and fewer than 7 percent died. Over the previous 18 months, the average stay for such patients was 8.5 days, and 17 percent died.

 

 

Reality check

This is in a nation where the vast majority of the population has either been infected by a variant of the coronavirus, or has been vaccinated, or have died (rather like the UK except with vaccination VS infection numbers reversed)

- and despite the being the very early days of this variant and the prior variants killing vast numbers (at least 89,000) of the more susceptible in SA (a broadly similar 'ball park' percentage of the population to the 150,000 dead in the UK),

its still spreading like wildfire and more than 6 percent of the early hospitalisations are  dying ...

well a week past having the moderna booster and nothing symptom wise to report. Had a few headaches - more likely eye strain, and a couple of hot face flushes - as I do from time to time

Arm was a bit sore for sub 24 hours perhaps due to the 15 year old (as looked to an old fart) who jabbed me - thats about it

 

 

Get your boosters folks - I'm of the solid opinion they are needed - especially for those who had the O/AZ

Confusing plan B to be implemented.

 

Work from home if you can from next week which most people who can do so, are already doing.

 

 But many jobs require people to work from business premise, because of the nature of their jobs..

 

And people can still go out to pubs and restaurants, where they don't need to have covid passports or wear masks.  So those who serve members of the public face to face, will be enjoying night out eating and drinking, before spreading germs the following day at work.
