    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you 
    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just had second jab and was given the pfiser  sorry for spelling,  was asked if had any problems with first jab, told them what happened, a Doctor was called  and straight away she said  I     should have that jab, also said mine was not first case!

Let you know if   get any side effects xx

Likely accurate but now historic in that more recent deaths don't appear to be mainly among the elderly and people are still reacting to whatever the BBC says they should day by day.  Yesterday's outrage is easy forgotten it seems when replaced by today's headline.

Little point, suddenly cant log in with my usual old firefox - wont accept my login, well seems to accept it but doesnt log me in and throws me onto the 'you cant access that page you need to log in'

Confirmed pasword etc Ok so its a new issue with the old firefox - but thats what I use and not constantly firing up a different browser - so cancelling notifications and probably gone unless I can (easily) sort the issue this site has with my proxied and protected firefox

NHS staff 3% pay rise will come at cost to other services, No 10 says

The Government has confirmed that there will be no new money to fund the 3% pay rise for NHS staff in England, and the health secretary has been told to find £1.5bn of savings to fund the NHS pay rise, despite criticism that it will mean cuts to other services.

 

Lets all hope its by Johnson the reneger reneging on paying serco Dido and pals for the Test how much we can rip tax payers off for farce.

£37Bllion should go a fair way toward covering the real NHS's expenses.

Then he can renege on paying for the duff ppe - thats another £100Billion towards it isnt  it?

The reported reductions in infections is interesting - for all the wrong reasons - given no real scientist can explain it

 

Here's a few thoughts

 

First, the obvious - we expect a reduction in infections because its summer and people are outside more and its quite clear the infections spread far more indoors or in large crowds

 

Second, also obvious - the more people vaccinated, the less spread - we just dont seem to know in any detail how much  or against which strains

 

Now perhaps the less obvious,

* School Kids aren't being tested - but they are outdoors more - but effectively mixing less compared to classrooms

* There has been a significant shortage of lft tests - so less tests

 

 

Now things that I've not been seeing reported, although I have almost utterly lost faith in all the UK reporting

LFT's are best at catching significantly symptomatic infections, and the vaccines do reduce symptomatic infection quite significantly perhaps 60% or more - but thats 60%+ of infected people walking around unknowing - even after lfts.

I've seen this myself with experienced people testing neg on regular testing with LFT's - starting to feel ill and testing positive with PCR and those they have been in close contact with also testing positive via PCR after ALL getting negs with regular LFTs.

None of those I am aware of are as yet seriously ill.

 

That seems to define a vast number of people walking around, asymptomatic, not caught by LFT's, but still infectious, would be caught by PCR's and clearly speeding even in controlled environments - so imagine whats happening in shops/supermarkets where more have stopped wearing masks etc.

 

- and we know infections=mutations

The gov MUST know this. I'm seeing it reported in local hospitals and nursing homes

The vaccine is actually reducing the already limited effectiveness of LFT's in flagging spreadable infections. So both an expected  boon and a un-stated (so far) risk

I'm baffled too, TJ, but it's certainly too early to draw conclusions on what's happening.

 

I did see that there are a lot of cases in people who have come into hospital for non-covid related treatment without symptoms but have tested positive. Someone said it could show that the vaccines are reducing the severity of the virus but it still means you've got untested asymptomatic people who are positive wandering around freely.

I cant think of any other explanation and it does mean the virus is spreading, transmitting and mutating.

I understand some of the lockdown restriction removal, but removing mask and distance is just madness, but I suppose people were heading that way anyway with Johnson and crews antics and messaging.

 

Oh and our local Morrisons, mismanged as it is, removed the one way entry/exit system months ago and re-implemented the bottleneck eveyone past tables of sugary pastries etc .. and each other

 

Tesco haven't - they've maintained the seperate in/out

I know. You've got Johnson telling everyone to 'be careful' without spelling out what that means, but it'll be 'the people's' fault if it goes wrong.

 

And then there are ministers and right and left wing commentators bragging about throwing away their masks and not 'cowering' when faced with the virus. As if covid is listening to people who want to tough it out.

Sick to death of getting uh oh broken link page everytime I click on last page of a thread or even some actual links, let alone browser coming to grinding stalls everytime this site is accessed necessitating shutdown and restart of browser (new and old when it worked) after leaving this site to get them working properly elsewhere again - causing stalls typos and allsorts. new variant vaccines are unlikely to change my opinion unless one comes out that is truly  a 'rock star'

Even NYT is saying that the EU has overtaken the US in percentage of population inoculated, and France and Germany are maintaining vaccination/test/mask/space requirements that the UK has thrown to the wind

 

 

Interesting that Israel is offering a third Pfiser vaccine to over 60's

Such a large-scale booster campaign is a world-first. Health officials are worried that the vaccine's efficacy reduces over time, but some critics...

 

So from what I understand:

* All vaccines effectiveness reduces over time, more against infection and transmission than protection against death/severe illness it seems

 

* O/AZ Antibodies are vastly lower and reduce faster than with pfiser - lower at peak than pfiser after 6 months from what I can see, and reduce most in older folk and those immune compromised (hence some of the figures from aids epidemic Africa)

 

* There are some (unconfirmed as far as I can see) claims that the O/AZ vaccine generates more T-cell response than mRNA vaccines

 

So still seems to me that anyone who had O/AZ vaccine doses needs an mRNA vaccine as a booster,

and its perhaps worth examining if those who have had a pfiser, and are in generally good health should be offered an O/AZ as a booster and whether that should be recommended. 

 

 

oh and I still cant understand why the UK is more OK with people coming in with delta/delta+ on the increase and NOT those with beta .. when with the rest of the world its more the opposite ... despite that the O/AZ vaccine seems even less effective against the beta than the delta which all vaccines have lower effectiveness against..
