    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.
    • This other entity doesn't know what's going on.  To be clear I had huge equity.  No-one would ever expect a lender to erode all my equity.  The question is - if anyone knows the legal answer - on the basis they have a charging order - could they make an application for an order for sale?  
    • Is this place near to you? I ask for two reasons. If you can easily go back, then get photos of the signs.  On GM and Parkopedia there are various comments about the signs being pants. Also go back to the school uniform shop and ask the manager there for contact details for the retail park (which I've Googled & Googled and got nowhere).  The school uniform shop will just be tenants of the retail park, they won't be able to do anything.  It will be the retail park that called EPC in, and we've seen loads of cases where the organ grinder has intervened and called off the monkey.  As for EPC, aye, ignore them until LoC stage.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Had a laptop for a month, but required to work from office.   First day working from home as a trial and I can see why people like it.   Two minutes commute to work.  But supply of coffee nearer as well a food supplies, so it could become unhealthy.   The plan is to do a mixture of office and home based working. 

 

Virus numbers looking worrying and a full lockdown quite possible.  So if this happens, then I can see most people wanting to work from home all of the time.  But I work in the public sector, so our health and safety appears to be decided by Downing Street.

Heres a little test for cjregg spicer as he claims the rule of 6 is straightforward

 

As he says he is ignoring me - clearly to continue avoiding answering these straight forward sort of challenges to his regurgitated handcockian and Boris the Liar claims delivered from his white-wash house,

I would suggest anyone just fires this at him rather than rise to his continuous bait. He's answered few enough questions fired at him regarding his effort and support free sound bites.

 

A simple social grouping of 6 households, an entirely normal mix of family and friends, who normally socialise and support each other (fetching/taking kids to/from school, looking after kids and watching out for grandparent while rest of family working etc etc)

Working age adults - Some at workplace, one on furlow, some home working.

Kids are in various years/bubbles at 2 local schools

Most would put CofE on forms religeon wise, less than half would put none.

A number are members of social/sporting clubs which allow guests

 

1 with 3 members

2 with 4 members

1 with 5 members

1 with 6 members (including a grandparent still active and in fairly good health age and medications considered)

1 with 7 members

 

As cjregg claims its all straightforward and doesn't change

Where, when, how and why can or cant some or all of them meet?

That's not attributing blame, it's identifying a cause. But here on the bitch-fest that is this thread, facts don't seem to matter much.

Yes, quite distinct difference

Scotlands first minister does seem to quite clearly demonstrate she understands the reasons, the personal situations and have real sympathy in stark contrast to Johnson the Liar and Handcock

 

and I note MP's are still getting away with breaking rules when they should be both leading by, and punished as examples

Latest (available) government testing figures for 10-september-to-16-september (10 days ago)

 

"587,173 people were newly tested, consistent with the previous week but an increase of 30% compared to the end of August."

 

*** Which works out to UNDER 84,000 people a day being tested that appears to be collapsing Handcock, Dido and Sercos Trace-a-test

- 30% up from only around 65,000 People tested a day at the end of August

 

.. for a claimed 240,000-300,000 'capacity which has and is collapsing when even a 3x increase in people being tested should be within the long and still claimed 'capacity

 

Given the lack of newer figures - they cant be anything to shout about eh?

 

So my prior estimates of around 60,000 climbing more recently to 75,000 were over estimates; but right in the ball park; and only exceeded in the last few weeks or so.

England’s troubled and much-delayed NHS Covid app does not accept test results processed in the country’s government-run laboratories, hospitals or as part of an official survey, officials have admitted.

The app’s official account said on Twitter it could not link to test results taken in Public Health England (PHE) laboratories, at the National Health Service (NHS) or as part of a survey run by the Office for National Statistics (ONS).

The data processors for the app:

  1. NHS Professionals, (which is providing registered medical professionals to help contact people who test positive for coronavirus to identify their close contacts (NOT #RealNHS and since making a profit from the #RealNHS the Tories have been trying to sell off cheap to the private sector))
  2. Serco UK, which is providing staff to call the contacts of people who test positive and provide guidance on self-isolation
  3. SITEL Group, which is also providing staff to call the contacts of people who test positive and provide guidance on self-isolation
  4. NHS Business Services Authority, which is sending text messages and developing management information reports
  5. Amazon Web Services, which is providing the secure UK-based storage location for the contact-tracing service information
  6. The Cabinet Office, which provides the GOV.UK Notify service used to send contact-tracing texts and emails
  7. Kainos, which is assisting with the operation of the contact-tracing website system

Of course, some of those are 'registered' and host services in the USA so are beholden to USA data release rules.

No same app, and a testing regime thats seriously broken, try to book a test locally, get offered Inverness an 850 mile round trip, £400 rail fare if you need to go same day or next, or Cardiff 400 mile round  trip, 5 hours each way on train or by car.

The app doesnt work with pre android 6 or the very common older apple phones either does it
