    • Sorry I didn’t think to come and update this.    So the outcome was that he went to court. Apparently the judge told the landlord off for not sending a letter before action but did nothing about it. He didn’t accept all the damages the landlord claimed, and told him off for accusing my friend of deliberately and maliciously damaging anything, and he awarded him small amounts of the damages he claimed for. The landlord had also made an awful lot of things up that never existed and accused my friend of stealing them, and the judge didn’t accept any of those claims.   However, I’m back asking advice now. So he made an offer of payment via the court forms, sometime before Christmas and straight after the hearing. The landlord didn’t reply so the court accepted the payments.  My friend has been paying the £10 a month each month. Then a couple of days ago he had received a letter from court with a hearing date in a couple of weeks, and a very irate letter from the landlord saying that my friend has consistently lied and that nothing he says should be believed, and that he wants the bailiffs to be called on him and that he absolutely refuses the payment plan. The letter is marked as received by the courts in December and this is the first that’s been sent since then. My friend and his wife are now panicked, what does this mean? And can they now get bailiffs sent round? He earns an ok wage, which somehow the landlord has referred to in his letter, but he equally has a lot of expenditure and can’t afford to pay any more. What will happen at this hearing and can they send out the bailiffs just because the landlord wants them to?    I have no clue what to advise him, can you help at all please?
    • Thanks Bank – I took your cynicism / experience on board and responded thus: Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands.
    • The other thing is that you are making a big mistake imagining that they are at all concerned about wasting court costs et cetera. They are only concerned about being obstructive and discouraging others.  
    • I have dad's last will from 2019 which mentions the trust. I am in the process of going through probate as the only thing that needs probate is a couple of shares he has (under £3000).  Speaking to my brother and my dad's wife they wouldn't mind going with another solicitor if we need to pay extra for the trust.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Interestingly, the guidance states that care homes can refuse to accept discharged patients although that would clearly put them in a very dark light and handcock and co would no doubt to to fry them in the media/parliamentary questions if they do

- in addition to the strain it puts on the patients.

 

Where is the extra capacity that the summer 'lull' should have allowed to be put in place?

Changing the subject slightly, very senior people in the NHS asked Ireland for help with Covid lab tests. This tweet also says Ireland has spent the summer building up to 100,000 tests a day which is impressive for the size of their population.

Didn't dodo harding 'promise' yesterday that daily covid stats would be restarting - yet only gave the ones for the week 10th sept?

 

I still dont see any. Have I missed them or was that anther handcockian 'sometime in the coming months and decades announcement?

Lets hope they include number of failed attempts to book a test

That does make some sense to me.  The drunker people get the less likely they are to attempt any level of social distancing, behaviour in general deteriorates. It’s also why ‘table service only’ is introduced.

All for nought , the only way to stop this now is by imposing a national lock down, the public feel safe right now, that's why it's so dangerous, social distancing has gone out of the window. That's the one thing delaying a lock down. Unfortunately, ghoulish as it sounds the public won't be on board until suddenly hundreds are dying in hospital. Nothing else will stop Bob having his Friday night booze fest with his mates down the dog and duck.

Maybe they're hoping the threat of it is enough. 

The next major issue will be the collapse of Universal Credit as many thousands of jobs are lost once furlough ends.  They'll claim they couldn't see that coming too.

Anyway, about time it was said straight

 

The Governments' claimed 'Capacity figures aren't 'interpretations,' they are outright lies

Capacity by definition is "the ability to receive or contain" - and its collapsing at little more than 80,000 a day at best.

There may be 120,000ish 'tests' - but Governments own figures as stated quite clearly state 81,000 people tested a day (is that best, or average?)

 

So by definition and example (artificially holding back results to boost a single days figures aside)

- 80,000ish a day would seem to be the actual true capacity of the UK's testing system to test people - even if certain parts of it MIGHT theoretically be capable of more

According to the data published today, an average of 6,000 people in England were infected per day between September 4 to 10.

... (1-2 weeks ago - so extrapolate)

 

The rise appears to be driven by an increase in the number of people testing positive aged 2 to 11, 17 to 24 years and 25 to 34 years.

Full UK national lock down for 2 weeks possibly happening soon.  This may or may not include school and non essential shops.

 

Would people support this, if this was likely to reduce numbers infected by virus during a 'second wave' ?

 

Or is a lock down only likely to have a temporary effect and therefore it is not worth doing ?

 

I could see a national lockdown end of next week or week after, given the sharp rise in infections over the recent week.

a two week lockdown without a vaccine or REAL increased test capacity at the end of those two weeks is largely pointless.

We are at the start of the upsurge - and especially if schools aren't better protected.

 

- look at the figures showing the increase in young person infections and those figures are massively artificially low due to the policy of telling people they cant have a test if they dont have symptoms, and no tests available anyway.

 

What we need is competent leadership who have other than their own interests at heart - and we simply dont have it.

 

On the infection stats

Given the guesstimate that only 30% show symptoms, and the policies, that infection rate needs to be multiplied by 3 at least - even if everyone that thought they needed one got a test - and they aren't.

Dr North asks what will they do imposing telephone number fines that people can't pay?   Well maybe they send in bailiffs to evict them and snatch their home if an Owner Occupier?  Off to prison if tenant and all goods taken and sold under a new emergency power given to bailiffs to take the lot regardless?  The bailiff firms will love that, they have been doing no business recently.

@tobyjugg2 It has been decided that you will now be responsible for deciding on the Covid-19 measures that Government will apply to England.   What measures will you introduce ?

 

If it were me deciding, I think I would enforce PPE requirements in any place that is open to the public and that includes schools.    So both Children and all school staff would have to wear face masks and those that cannot wear masks due to a health condition, should not be attending school anyway.   In terms of how to enforce. I would employ more Council enforcement officers, with the power to issue £100 penalties to people and £1000 to any company/organisation.   These penalties would increase for second, third and subsequent offences.

 

This virus is going to be with us for months or years, so we might as well  get used to having to excercise reasonable precautions.   Lock downs should be used when they need to deploy a fire break to try to deal with the virus spread in areas.

Implement the VERY cheap and easy temperature checks on all people entering schools, supermarkets, transport hubs, all frontline staff before starting work every shift/day etc - as many countries already have. 'Technical options like thermal scanners at airports/transport hubs should have been in for 3 months now at least. Supermarkets implementeda necessary delivery before - use for those that fail.

- As repeatedly stated, wont get everyone, but it would get in the order of 30% and those the ones most likely to spread, its cheap and very easy to implement- apart from food market rejections - which might require a member of staff to actually get their shopping for them..

- Alongside the actual benefits - Just imagine what peace of mind a temperature check would give to most people

 

* Honest presentation of the facts - which would themselves justify local lockdowns and empower proper management of the epidemic

 

* All front line staff swab tested at least weekly and more often as necessary which will require ..

 

* Actually increase test capacity rather than just lie about it - why can India do more tests than our rich nation?

- Is it that nobody trusts Johnson to actually pay the bills for goods and services received?

 

* Everyone who is ordered to isolate after a positive test gets national minimum wage payments (in mind of mortgage holidays etc) from day 1 - no more- no less (its one of my pet issues which my lefty friends disagree with)

-  - that national minimum wage is too low is another issue.

+ people who breach those self isolation rules - heavy fines and tracking ankle bracelets monitoring their isolation - what they are doing IS at least as criminal as drivining a car deliberately dangerously and putting lives at risk -- if they are being paid (every 7th day - 2 payments) at least minimum wage to stay at home from day 1.

 

* Cant emphasize this enough - Honest presentation of the facts - which would themselves justify local lockdowns and empower proper management of the epidemic

 

* Implement home schooling with proper checks on progress and work  as some schools have. leave the school spaces for thiose that really need them. Maybe even give tax breaks for home schooled families based on results.

- what cost a tablet loaded and checked each week with a months school work for each kid - even if the kids tabs need to go to school grounds once a week (month if necessary) to upload tests/work and download the next batch of work from a school server?

 

All the above should have been in place for months now, or last month at the very latest. None are rocket science.

Yes - as is the next one. These sort of infections are NOT going to go away - quite the opposite.

China is implementing localised lockdowns with perhaps limited success - but the operating point there is 'success' - which is what we need to build on - not build on failures, cover-ups and lies
