    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thats Johnsons (and to a certain extent others) 1840's empire frame of mind for you

'they are miles away,. It will take months or years to get here and anyway, we are Englishmen(ish) so it wont dare try it on with us, and if it does our (quivering) stiff upper lip will shake it off after a cup of tea.

We have people coming here from there in those new fangled airyplanes, in fact we told them to.

My God! You claim they are little more than 12 hours away ??? !!!

I know some people have taken the sort of stance (even one here) that 'there is no scientific evidence (at the outbreak of a new/mutated respiratory virus) that xxx.213 is spreading in the UK population, let alone that xxx.213 which causes high temperatures, coughs and respiratory problems is spread through the air or contact or any of the ways other respiratory diseases commonly spread

Breaking News

Handcock says that reports that the UK has run out of testing kits is false news and that 'the system' is sending people on hours long drives so they can see if they are fit to drive and to test their eyesight which is now part of the official testing and nothing to do with incompetence or lack of testing kits and is all to do with following the shining example set by Dom the Covid hero.

When asked to confirm his statement, Handcock (with hand on Johnson .. heart) said that he had just confirmed this by looking at the capacity on his spreadsheet and it still showed available capacity as it had from the start.

He announced that in fact the capacity for the spreadsheet to report capacity had been upgraded by one of Doms companies at the bargain price of £10M and it now had a capacity to show 200,000 tests per day, and the spreadsheet would be upgraded again at a similar price in the very near future with a capacity of showing 500,000 tests a day capacity.

Handcock was confident that the capacity of the spreadsheet would quickly be further upgraded at a similar bargain cost to a capacity to show 1million tests a day capacity.

There's at least one discussion going on Twitter about the mortality figures for Covid being 'massaged'. Someone worked out that since the government put in a cut off of 28 days after being tested positive, the figures have gone down by just under 30%.

It was inevitable that the figures would be massaged one way or another, no way could government allow figures such as 50,000 + deaths be allowed to hit the headlines !

Yes, I had seen this and also the first person to die in the UK (Nottinghamshire) apparently was tested on February 21, 2020.  Interesting that government did beggar all until almost the end of March !!

I wouldn't want to be running a school at the moment. HMG have released guidance on a Friday night before a bank holiday and now expect schools to organise a rota system, presumably with a cleaning regime between the two groups on the rota. Some English schools start back next week.

Teaching and leaders' unions have been asking for the guidance for weeks.

Note added: This is for schools in lockdown areas, but anywhere can go into lockdown with very little notice.

Problem UK has, is that it is an international hub for business and tourism. And UK citizens are perhaps more likely to travel abroad than say many other counties.

Government were late in applying lock down and implementing travel restrictions. When there is a future inquiry about this, I think it will confirm that there was conflict between Government Ministers and the many advisors including SAGE.

In other countries they have been far stricter in applying travel restrictions. In Australia, they have totally closed borders between states, when one state has reported a certain number of new positive cases.

I think the UK appears to now be following a reasonable steady approach with schools gradually returning, but it is a shame there have been last minute announcements. I expect an increase in CV-19 cases and local lock downs, which is going to make it very difficult for many months ahead. Businesses will continue as they are with office workers based at home for some of the time and I think this will be a permanent change.

Many people will want to continue working from home for sure, but the Polioticians would rather they didn't now, but they put obstacles in the way, with new restricted accesses, and C Charges,  those will reinforce people not wanting to return to office with the cost of the commute.

So what happens when you end up with a class full of asymptomatic kids, who take it home and share it with their siblings, who take it to different classes/schools and eventually one of the parents or grandparents ends up seriously ill before anyone notices?

Let alone that the parents pre-symptomatic are pressured to return to work when they could work from home - taking it to an office environment and city center environment?

Sounds like a 'herd infection' policy to me.

Alternative?

What should have been in place for months

Kids at school one or two days a week (staged) with home schooling work for last week handed in and fresh work handed out

Who is going to go out from the office to queue outside waiting to go in greggs for a sausage roll ?

So much for 'saving' city center businesses by forcing people who could work from home back into a more densely populated environment.

Sounds like a 'herd infection' policy to me.

Depends on how many infected people are in circulation. passing onto others.

Yes Covid-19 cases will increase, schools will close, as will businesses etc. but on a local level and not a national lock down as before.

Not sure a herd immunity policy is being followed, as I don't think many of the Governments advisors believes this would be helpful.

There have been re-infection cases and some evidence to suggest any immunity after having the virus may be short.
