    • Thats because this claim has not been allocated as yet hence the above hearing *Case Management " to determine the directions (N157 Notice of allocation) which will follow after this hearing.     • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This doesn't make much sense when they also want to keep the economy open. I've read articles where the authors say that a properly operated testing system can save money because people can keep on working or spending to keep economic activity turning over.

 

I don't think our Matt has necessarily grasped how a joined up testing system works and certainly the parallel private one isn't giving vital test result information to the very people who need it, local authorities.

The muppet has deliberately kept the LA's out of the loop relying on Central C & C@ PHE, and his buddy-pals in Serco and G4S.  Gething & Drakeford little better in Wales. Apparently they were going to Centralise testing in Cardiff & Swansea, until they were told its a 5 hour trip from North Wales 180 odd miles when they had a 5 mile from home restriction in place.  Luckily they then sorted local testing..

Tories seem to hate LAs but I'm convinced that if they'd been given the resources instead of starved of cash, they'd have done a better job and probably for less money.

 

Did anyone see the recent interviews with Matt Hancock? Asked about whether people are self-isolating after holidays in Spain, he came out with the biggest load of - err - platitudes without giving any detail at all. Charlie Stayt on This Morning only wanted to know how many people are complying and how it was being checked and I was none the wiser at the end. I wonder if Matt actually knows how it all works, assuming it is.

You're right about the police, TJ, they said a while back they didn't have the manpower, didn't they?

 

LA contact tracing has a very high success rate and people seem to trust them enough to give them the necessary information. Then they were meant to be followed up by under-utilised NHS volunteers, AIUI. With the right resources, I'd have thought they could do this as well, but of course they don't have the resources. :classic_sad:

Must admit though with O/H and DIL both NHS key workers (with no pay increase pending)

We would book a test despite the data privacy and security (lack of) issues, as we already have once when O/H had an upset tummy and GP surgery was 'OMG Covid don't come in'
