    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.     • In the SAR, I received the original application, lots of computer print outs, yearly statements from 2013 and the new emails regarding my complaint. They sent me a £50 cheque after I chased them for the SAR after the 30 days. They said they was waiting for me to respond to an email (which I never received) before sending the SAR

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No HB looks abysmal for sure, Dr North has ahad a pop at Boris and Demonic again, but also some salient points about the Hancock's busted Track & trace, with Data Loss Dido in command.  My observation is that with el cheapo Serco call centres, and target driven operators, there will be errors.  It doesn't apply to Wales, but given operators often misdialling due to time constraints and targets, they might say call someone in Wales, and the contact they are supposed to have been in proximity has never been within 150 miles of the call recipient. 

Also it doesn't apply to Wales so what di they do when Call handler told politely to Foxtrot Oscar as no don't know who they are saying has been near and is infected?

You're right about people's possible responses to these phone calls, BN.

 

I may have read that they're considering penalties to stop people behaving like Demonic. I suppose it never occurred to them that the little people would take matters into their own hands and it seems to have come as a shock to be losing control.

 

Also, how do you know it's a genuine call and what's to stop malicious calls by people naming someone they don't like?

Durham police have carried out a very speedy enquiry and decided that Demonic did nothing serious enough to take further action.

 

What is this going to do to compliance with lockdown restrictions by normal people?

Is that also the case when he went back to and into Downing street after spending time with his sick wife who he believed was infected - before the trip?

Let alone that he has stated he believed he was infected (as justification for the trip)

 

So travelling large distances from home when infected is allowed

 

Travel to beauty spots is fine

 

Driving with acknowledged sight issues is fine

 

Visiting the properties of parents/grandparents properties is both fine and not limited to 1 person

 

Going into buildings full of people while you believe you are infected is fine

So it would seem that breaching social distancing is the only offense according to that statement, as long as if they catch you travelling somewhere hundreds of miles away and they tell you to go home (whether they are 'entitled to or not) and you do go home - thats fine too

 

 

So - social distancing..

How many videos and photos of him constantly breaching that over the last month do we need to compile.

There must be hundreds..

 

Bet he didn't warn the guy on the door at No 10 when he went out, or in, or out again ... the day he believed he and his wife were infected

I'd have thought so and even Matt Hancock said he'd get someone to look at that yesterday, I think it was. Then Robert Jenrick came along shortly afterwards and said they wouldn't be reversing the fines.

 

It does seem to be dual standards.

Then there is the issue of the Tory MP living in  his second home on Anglesey. They were there when Lockdown started, so they stayed there as his wife was having treatment in bangor Hospital.  Heddlu Gogledd Cymru are unpredictable they might have fined him if he attempted to go back to his main home, either on a roadblock at Britannia Bridge  leaving the island or Deeside on the A55

That's a tricky one, BN. If someone was in their second home when lockdown started and stayed there throughout, I'd have thought there could be some leniency.

 

Here's an article about Demonic co-owning his parents' farm with another person. Does that mean he went to his second home?

 

Also interesting comments about the farm receiving EU subsidies, after everything he's said about the EU.

Just yesterday Baroness Harding, the chair of NHS Improvement and the government’s lead on the test and trace programme:

 

If you have one of the symptoms of coronavirus, you must immediately self-isolate, she says.

You should then book a test on nhs.uk/coronavirus or call 119, she says.

Do not leave home for any other reason, she says.

 

So why didn't Dom do dat?

Yes HB he was right to stay there North Wales Police would have gone all medieval and made an example of him if he had been pulled trying to leave Wales, different administration and all that Welsh rules more draconian than English.

Question-    Can the Governments track & trace app really work  ?

 

There is news that the app has crashed,  but let us presume that the app is working.

 

In the building where I work, due to the construction, my mobile phone signal is not very good, unless I am sat near a window.  In an average day, I am normally sat at the same desk,  but I may move around the building for socially distanced meetings or for other reasons e.g toilet break, making a drink. 

 

I don't normally have my phone switched on all day and I may not take it with me, if I move to another area of the building.  But let us presume that I have my phone switched on, with Bluetooth  swtiched on, so this track & trace app can work .

 

What is the working distance of Bluetooth on most phones and could the app cause too many alerts for people to self isolate ?    

 

If you have one person who is tested as having Covid-19 sat in an office socially distanced in one corner, but has colleagues in the same office,  will this app think everybody sat in the same office has had contact with this one person for more than 15 minutes ?  This could lead to a lot staff suddenly having to leave their workplace to go into self isolation.

 

And what about visitors to workplaces ?  If employers are not recording time/date and movement information, the contractors phone may cause staff in a building to receive the app alerts, even if they have not had any direct contact for the 15 minutes.

 

I can see this track & trace app causing a lot of disruption in many workplaces.

Its chock full of issues UB  Personally don't trust Serco or G4s, had dealings with rthem in a previous Support Officer job where they were unpunctual, and kept someone found not guilty waiting for a week to remove the tag, so he was stuck in bail hostel until its removal.  Can see their Contact centres messing up, and false alerts due to misdialled calls to people out of jurisdiction say Wales, or Scotland, as Mobiles aren't area coded as such.

Here is a take on how useless the government track and trace might be, with all the usual suspects involved screwing it up with cheapo solutions, wonder if Serco are using Citrix as its connection backbone? its often causing connectivity issues, there is a nickname for Citrix that starts with a colloquial term for excrement so replace C with Sh
