    • OK, thanks, I won't wait for them. On a side note, some of the posts on here are a bit frustrating, I read through five pages or so of someone going through the court process rooting for them as I'm reading, then nothing, not heard of again. Left here wondering what the outcome was, lol!
    • Hello Caggers,   I've been trying for years to get an old EE account wiped off my credit file. It was opened in 2013 and almost immediately defaulted but was shown as "Payment Arrangement" ever since. I contacted EE by telephone in 2022 and was advised it had not been wiped because there was still £69 owing, I paid it and thought it would correct once the CRA's updated their reporting cycle. However, it has still not been removed. I made a formal complaint on 27/03/2024 and have had contact with the executive team who advised that  "EE account ......... has now been deleted from the Credit File as it failed to close as it was reporting the payment arrangement set up despite, as advised this failing which should have resulted in a further default showing.  Please be advised the deletions we have completed take 24 hours to update if a paid service is used to view the Credit File. If the customer uses one of the free services to view the Credit File, the recordings update in 24 hours but the changes can take up to 30 days to be visible on a new copy of the Credit File. I have requested compensation and been advised by EE that another team are looking into this. That was almost 2 weeks ago and there has been no contact since, despite me chasing it. I do not want to go to court and would rather settle this amicably. However,I have been advised that I might have a claim for aggravated damages due to the length of time the incorrect reporting has been on my file and the fact that I told EE about this issue and paid the demanded outstanding amount of £69 almost 18 months ago. Should I just wait for EE to reply or should I start building my case against them? Is their statement admissible as evidence of their blame or do I need to dig a bit more? I made a DSAR which was initially rejected as having no data found yet. I trawled my e-mails from 2013 and found the account number and mobile number, I'm now awaiting the result of my 2nd attempt at DSAR. I have very little in the way of proof of actual loss except a mortgage refusal e-mail from HBOS in 2015. I have also had high interest loans and credit over the last 10 years but again cannot directly attribute this to this one specific error. There were other items on my credit file that could also have contributed to a low credit score too and I'm not out to cash in on anything. I want to make sure I don't end up shooting myself in the foot for any obvious reason and would appreciate any help from anyone who has had similar experience with breaches of DPA.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

that Cummings drove 250 miles from his London home, to a separate building at his parents property, to be isolated and so his sister could drop of groceries outside the door

 

Well even that is a breach of

 

* Leaving your home AT ALL while a family member has symptoms

 

* travelling restrictions from one perfectly adequate home isolation to someone elses home with or without symptoms - exacerbated by having symptoms

 

* being on his elderly parents property when the rest of us were told we couldn't even talk to parents over the garden gate - let alone if we had symptoms

 

 

I'm sure theres many more breaches

 

and Johnson supporting it is beyond the pale .. although quite normal for him.

 

 

If the rules don't apply to the rule makers ...

I don't think I've ever seen anything like this. Cummings' gang said earlier that the police didn't visit him in Durham.

Yes, the tale is changing, but its simply wrong in all versions.

 

If the sister (or grandparent - another breach) was to look after the child, then the sister should have fetched the child, not have infected adults crossing the country in breach of requirements for them to stay at home..

If the child stayed with Dastardly and OH, then there was absolutely/utterly no excuse for travel.

 

So, there was no excuse for symptomatic OH and Dastardly to travel - quite the opposite.

 

Oh my, we had no options simply doesn't wash.

 

and with the claims being made - johnson (who must have authorised the press releases) is lying or the police are lying

As Tory MP's are whipped by Johnson to support Cummings, amidst growing reports of Cummings repeatedly flaunting the lockdown rules which the rest of us were told were instructions with penalties

 

and Cummings and his wife wrote in the Spectator about their 'coronavirus experience' without once mentioning either their child or that they were away from their home in London

 

and while his wife claimed he was bedridden for 10 days, multiple witnesses say they saw him:

 

Out and about outside the property

In the graden with AbbA blaring away

Repeatedly seen miles away from the property at beauty/visitor sites

Back at his parents town after returning to Downing street apparently 'recovered'

etc

etc

etc

 

All this aside from the simple fact he should simply not have left his property in London 'for any reason', let alone be travelling around the country.

I think i have heard the political advice before, that "once political/media advisors become the news for more than the normal 48 hour news cycle, they have to be removed".  

 

So if Dominic Cummings is still the main news story after today, then I would expect a decision will me made. Probably an apology, followed by a temporary change of role away from Downing Street. 

 

The worst thing about this is that it takes concentration away from looking at how Government can prepare the country for a steady move to a new normal safe way of life, with more businesses open and people able to enjoy forms of leisure they have been stopped from enjoying.

Yes, and decent people have resigned for far far far less

... and their leaders, including Johnson have said it was right that they should go

 

That there has been delay in this case is already unacceptable.

 

 

That such extreme repeated offences, if true, are not prosecuted is unacceptable, let alone that the person is sacked

.. and any ministers who defined and/or promoted those rules and the penalties that people breaking them should suffer who are actively supporting him should also be sacked (IMO) as the absolute definition of hypocrisy, dual standards and abuse of position if they don't have the common decency to resign.

 

 

That senior people are supporting him seem to me to be rampant examples to everyone who thinks that they have the slightest excuse to ignore the lockdown RULES via some interpretation that could only have have been run through an English/ Emesal translator a few dozen times.

 

 

 

If those defining the laws and rules abuse them when they happen to be inconvenient, then IMO they have absolutely no right whatsoever to be defining or demanding the enforcement of those rules, or be in any position of national responsibility.

The police and crime commissioner for Durham is writing to the chief constable to ask for an investigation into Demonic's movements. Does that mean they can look at his sat nav record?

I imagine that many parents, even more so single parents  'Feared they may be incapacitated by the virus'  However, this statement is weird.. did they both have the virus or not.. or simply were afraid they 'might' get it ? 

 

Why also was DC's Father enquiring about security for his Son.. surely that is something that should have been done by government or DC himself ?

At the point they left for Durham only she was showing symptoms. I think it's reasonable that as her husband he feared he may be incapacitated by the virus and indeed he was. I'm not defending him - far from it, just interested in establishing the facts.

As I understand it, it's not certain what security issue Cummings senior approached the police about.

Haven't they already implemented changes that allow the tracking and tracing, with or without permission, of people who have or are suspected to have, or are suspected to have come in contact with someone who is suspected to have ..  coronavirus ...

I think this political spat that is happening could have very serious consequences in the near future.

 

With the Summer weather now with us and people wishing to enjoy holidays, as well as day breaks away from home, I can see the social distancing measures totally breaking down.

 

Weston Super Mare Hospital has had to warn that they cannot take in any more patients A&E, due to a large increase in Covid-19 cases.  

 

These coastal resorts if they start having large numbers of visitors, may see a rise in Covid-19 cases and this will spread, causing the country to suffer a major second outbreak of the virus.

 

Dominic Cummings is one man, but it is what the news story may cause, that is the problem.

 

Spain is saying they would welcome British holidaymakers from July, but the Government will require a 14 day quarantine when they land back at home.  I can see many people either totally ignoring the quarantine requirement or just not going back to work for the 14 days, trying to take the time off sick.

Exactly why the other folk resigned.

 

Not even because they seriously breached the rules like Rasputin,

but that ANY infringement by those in power undermines whole process then, now and going forward

 

As is happening with every hour this goes on.

 

He should have 'resigned' or been sacked back in April when Johnsons office were first asked about it. Not allowed to carry on in his job or his (alleged) breaches.

I think anything other than resignation, which he shouldn't present to the nation, will be seen by many as that the  rules dont mean sheep dip.

 

Expect a hardening of 'the rules' for everyone else.

 Cummings will offer an apology for this panicked reaction to his wife becoming ill with Covid-19 symptoms and  say he now realises his actions were not within the spirit of the rules announced by the Government.  

 

It will be a continuation of what Boris said yesterday and with no offer of resignation.  

 

And then Boris at 5pm will reinforce the Government rules as they stand on Social Distancing. 

 

Or Cummings will resign as the worry is that the Tory party will start looking more closely at whether Boris is really up to the job.

 

Real shame that politics has become involved, when the subject is so serious.  It is not just the deaths due to the virus, but many businesses will shut for good and some people will be unemployed for a long period.  And every time there is a recession, there are awful consequences.
