    • One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.
    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other!

    • the Town and Country [advertisments ] Regulations 2007 are not easy to understand. Most Council planing officials don't so it's good that you found one who knows. Although he may not have been right if the rogues have not been "controlling" in the car park for that long. The time only starts when the ANPR signs go up, not how long the area has been used as a car park.   Sadly I have checked Highview out and they have been there since at least 2014 . I have looked at the BPA Code of Practice version 8 which covers 2023 and that states Re Consideration and Grace Periods 13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN. It then goes on to explain a bit more further down 13.5 You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is. 13.6 Neither a consideration period or a grace period are periods of free parking and there is no requirement for you to offer an additional allowance on top of a consideration or grace period. _________________________________________________________________________________________________________________So you have  now only overstayed 5 minutes maximum since BPA quote a minimum of 10 minutes. And it may be that the Riverside does have a longer period perhaps because of the size of the car park? So it becomes even more incumbent on you to remember where the extra 5 minutes could be.  Were you travelling as a family with children or a disabled person where getting them in and out of the car would take longer. Was there difficulty finding a space, or having to queue to get out of the car park . Or anything else that could account for another 5 minutes  without having to claim the difference between the ANPR times and the actual times.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Its been that way for years. They still fly/travel to meetings.

I tried to start to change that many years ago where I was - failed.

Do agree with that.

but all that aside, there will still be people who fly (float, train or drive) in and out of countries - like those 182,000 private flights I mentioned

and one of the ONLY fast, automatic tests we can implement, not just at airports, but all major transport hubs and quite possibly more - is temperature checks.

(please someone come up with something else)

We need them in before the end of Autumn not just for Covid - but for the next one - which if its a pneumonic type or Covid mutated that way would have been 100's millions of deaths by now with how this has been mishandled.

To me, going on holiday is all about me and my family being happy and feeling comfortable. It's impossible for me to be either of those if I'm worried that said holiday is going to book one of us in for a trip to the local ICU.  If my employer is stupid enough to believe that running a Sales Kick Off event in California, like last year is a good idea, neither me , nor any of my colleagues will be attending. I suspect I'm in the majority opinion.

Captain Tom to Colonel Tom and now he's going to be Sir Tom. Wonderful news.

The article says HMG want to recognise unsung heroes of the NHS in due course. They could try having a word with Priti Useless who doesn't seem to want carers coming into the country from our nearest neighbours and is charging them hundreds of pounds a year to use the very NHS that they're helping to keep going.

"Lockdown is a crude instrument. On its own it can’t eliminate covid-19, but it buys a country time to prepare its health systems and to mount a public health response. Tragically, the UK government has squandered much of the precious eight weeks bought at such great social and economic cost. The question now is whether it is willing to admit mistakes and do what’s really needed to suppress the virus "

In reply to post #676

One minister more or less admitted that, didn't he, yesterday or today? I'm thinking of the comment about needing to protect the NHS and as I understood it that meant prioritising PPE for them, at the expense of the care homes.

OK, there wasn't enough to go round but what would have happened if the government hadn't wasted weeks when it did nothing about ordering supplies?

When you consider Johnson claiming in parliament the 'great success they had hitting 100000 tests a day and that they would hit 200000 a day by the end of the month

When the reality is they never did hit 100000 a day tests and there is not a cat in hells chance they will actually hit 200000 even on one day this month or next.

From what I can see, the peak number of people tested in a day hasn't actually exceeded 85,000 at best, and is commonly nearer 50-60,000 in reality

and the false claimed 122000 included 45,000+ tests sent out (so no one actually tested) and thousands of duplicate tests.

As Johnson + professor dooms herd immunity program requires 60%+ of the population infected

https://www.youtube.com/watch?v=2XRc389TvG8

They would seem to need schools and crowded public transport at full capacity to even start to get back on their target ready for the next surge this coming winter - not that it seems the warm weather is slowing covid much as of itself - unlike the early claims.

Mind you, Johnson is probably relying on his renewed attack on the darn immigrant workers who were dedicated enough to save him ... to reduce the NHS and make those dedicated staff who have been in the front line for us pay; and pay more;  should they then need it or even want to stay in this country on the front line.

Defines the man I think.

Yup it's like Noro Virus, can still shed Virus after 3 weeks, despite having recovered from symptoms. Nasty

PCR +ve doesn’t mean virus particles intact enough to be infectious.

Norovirus : patient is isolated until 48 hours post symptoms.

PCR +ve at 3weeks : without cell culture to confirm infectious, may represent detecting non-infectious genetic material (If the patient isn’t known immunocompromised)

(In a similar manner, for a +ve chlamydia test, “test of cure” is done at 6 weeks precisely because it is a nucleic acid amplification test [NAAT, like PCR but PCR is Roche’s trademark] and can pick up genetic material from dead organism if tested too early)

excellent find and informative, seemed a common sense approach

So, what has out government done besides manage to ramp up to about 60,000 tests a day. A pitiful effort for a so called rich, developed nation.

- around three years or so to test the population

and absolutely clueless other than statistical estimates of how many people are infected or have been infected let alone who hasn't.

- and with absolutely nothing in place other than social distancing (except in trains and underground and anywhere its a bit inconvenient) where drivers are apparently being told to go back to largely as before)

.. to 'manage coming out of lockdown

.. oh and of course a privacy busting, data grabbing app with no actual testing that could either:

* quickly put a significant chunk of the population back in 14 day lockdown untested

or

* be ineffective in managing the virus if they just decide to track to a single level of contact and test no-one -

. oh and give your data to anyone they want really.

you want medical insurance sir?

Lets look at your social profile and likely resistance to nasties to asses that risk ...

... Oh Dear

bet your loved ones life on it?

read a few summaries like the following link I include and you might think one way

Read the detail and it more likely you wouldn't.

The tests carries out so far seem to show that reinfection with milder symptoms and less shedding as 'the norm'

until you take into account all the test subjects were largely very fit, and otherwise very well with no underlying issues, and didn't also have a bout of say the common cold or flu as well.

https://pubmed.ncbi.nlm.nih.gov/2170159/

I would suggest anyone who thinks otherwise should look for the results coming from autopsies of Covid deaths.

Just heard on the News that footballers are going to be tested twice a week in the run up to matches.

Clearly far more important and necessary than front line workers or people who are 'tracked and traced'.

So as long as footballers are tested twice a week and politicians families tested whenever they ask, the ****ing world is saved then eh?

I liken the whole football thing to the availability of fish and chips during the war.  Apparently they were never rationed as they were considered essential for morale.  It's all about finding something which keeps the plebs quiet.

Footballers aren't getting tested because the government or NHS  thinks they're ''more important''. The premier league are paying for the tests privately (as indeed anyone could) as has been widely reported.
