just received a letter from tax credits saying that my wife and myself owe £1000 between us this is from 2006 I had a argument with them years ago and I stated to them that this was statute barred and never heard anything till today saying debt recovery or attachment of earnings will be put into place I don't earn a lot and have only 3 years before I retire what can I do

Hi there,

 

I’ve got past form with Tax Credits. First thing is not to worry.

 

Second thing is to send off for an SAR, subject access request. Google SAR Tax credits and it should take you to a link on Gov.uk where you can order this.

 

You will then end up with all the data that they have relating to you. Screenshots, conversations, phone call records. It’s a big box with a lot of information. This will allow you to check if they are wrong.

 

For example within around 1 minute of looking through my SAR I had found a made up phone call and my salary had been over estimated. They are known for making mistakes.

 

Thirdly Google Tax Credits COP26. This is their own code of practice. Have a read through and see if anything there applies to you in terms of their vulnerability criteria.

 

Fourthly, are you still entitled to Tax Credits? Even if it’s £10 per week then they will take a small percentage off to start paying the debt.

 

Finally if none of this applies, you will be able to ignore their bluster and negotiate a small monthly repayment.

Just to note that what they are doing where someone has to migrate to UK, even if there is a dispute going on, tax Credits send the details to Debt Recovery and start dragging it back at up to 30% of UC Standard allowance without a by your leave.
