Premier Park CCTV PCN - Double Yellow Line Parking

Hi,

 

Father has received a parking charge notice for parking on double yellows. Reason for parking there: Lorry was blocking car parking spaces and there was no other car park nearby (closets one was 0.4miles away). Not saying that this justifies parking on double yellows but a £60 fine is ridiculous.

 

Is it possible to not pay this or should I pay the reduced fee before the 14 days are up?

 

More information:

 

  • Incident date: 08/01/2020 @ 10:51AM
  • Date on NTK: Issued date: 10/01/2020 - (copy of both sides included in attached pdf)
  • Yes, received NTK within 14 days
  • NTK mention schedule 4 of The Protections of Freedoms Act 2012
  • All photographic evidence of the event included in attached pdf
  • I have NOT appealed
  • Parking company:  Premier Park Ltd
  • Carpark name and town: Euro Car Parts - Crawley, RH10 9AN

 

 For either option, does it say which appeals body they operate under?

  • NO, no mention of POPLA or Independent Appeals Service
  • Back of the letter says I can appeal on their Premier Park website and letter has a BPA logo

no such things as DYL's on private land - purely tarmac graffiti.

if everyone stopped blindly paying DCA's tomorrow

the biggest financial industry in the UK, DCA;s would collapse overnight.

Also as double yellows here are tarmac graffiti they rely on Law of contract to ground a claim, as no waiting is a Prohibition, it is impossible for them to have a Contract with you to pay diddly.  Others will be along soon with thoughts no doubt.

Okay DYL's on private land aren't the same as on public road and are not enforceable. What should I say in my appeal?

you don't appeal

waste of time and shoots you in the foot regarding POFA 2012

 

until/unless you get a letter of claim 

you ignore everything 

might help to go get pictures as in other PPS threads in this forum just in case.
