hello everyone . hope someone can help me out  


i obtained a replacement engine for my peugeot 208 from a peugeot specialist in birmingham a couple of months ago

 

i don't drive a lot of miles and now the engine has failed after 300 miles

 

.i paid £1000 pounds for the engine.

i have  tried to contact the company with no reply  


can i claim a replacement or partial refund ?

If a defect appears within six months of purchase then you are entitled to insist on a repair and if that repair fails then a refund.

You must assert the right in writing. Write the letter immediately and tell them that the engine has failed and as it has failed within six months you are asserting your rights under the Consumer Rights Act and you want to know what their proposals are to repair the engine and if they are unwilling or unable to repair it then you require a refund. Tell them that the right that you are asserting is the right to reject the engine if they failed to repair it satisfactorily. Any refund will have to include costs of any deinstallation and also we would have to discuss here the problem about then the cost of a good condition replacement engine because presumably you want to keep on driving your vehicle.

Send the letter immediately. Send it recorded delivery – first class – tracked – or whatever it takes to make sure that you know that it has been delivered to them.

You asked by my colleague @dx100uk about the name of the garage and you haven't responded. Please will you address this question.

The Google reviews look quite good. When did you try to contact them? Did you do it by email or by telephone?

Also, are you sure of your dates. You start off by saying you bought it a couple of months ago and then he went on to say it was five months. Is it within the six months?

It would be nice simply to contact them without having to send a legalistic letter to begin with in order to try and keep relations cool. How far is this garage away from you?

You haven't addressed the question about when you tried to contact them. I'm sorry to say but it's very difficult if you won't address questions without being prompted.

Given the fact that it seems so close to the six-month deadline, I think you should send the letter which I suggested above immediately. Send it tomorrow, post office – recorded and tracked as recommended.

Keep on trying to phone them. However, you should be do customer services guide and implement the advice there before doing anything on the phone.

When you have sent the letter please come back here and confirm this has been done. Let us know if there is any reply to your telephone attempts and then we will take you to the next stage.

Once again, how far you away from them

By the way I see on their website that they say their email address has changed. You aware of this? Are you sending your emails to their new email address? Maybe their phone number has changed as well.

However, you must send the letter asserting your rights

Thank you. So that means that if you have to return to Birmingham to have the engine repaired, there are also the expenses of getting there, getting back and then going back again to collect the vehicle.

These are recoverable losses and we have to add that to the equation.

Presumably the replacement engine was second-hand. Have you any idea what is wrong with it? Have you had anybody inspect it and give you an independent assessment as to what it needs to put it in order and also the cost?

Why did you replace the old engine? Was the car running up until then
