Hi, i have received a hand delivered charge for payment of money from scott & co. sherriff officers.

I have been instructed to pay within 14 days of the date of the letter. 

 

The arrears relate to the period between moving into my home and getting coulcil tax dd set up.

I have no personal problem with paying the arrears, however, at this time i cannot stretch to payment in full within the time given.

This period cripples me financially every year, like many other people. 

 

I have had a little search and read over an old post of mine on here about a similar thing around 10 years ago. 

 

I have printed off a time to pay direction which i will have sent off monday morning. 

 

Im really just wondering and hoping for clarification that this is the best course of action available to me at the minute?

Or is there anything else i can do?

 

Would be nice if i could only have to pay the ct debt and have the sherriff charges done away with,

although id guess that once applied, must be paid.

take the letter to the council office and arrange one direct with them

Really? I guess there has been a change in legislation since i last used it. 

 

Right, so i go to council tax office directly now.

I arrange a payment schedule with them.

Which letter do you mean for me to take?

The scott & co. one or the time to pay order?  

 

I doubt they would, but can they refuse to set up payment with myself direct?

 

What happens with scott & co.?

i'm not so sure this is not what you actually did before..it reads like it was.

goto the council rather than the sheriff, who work for them anyway.

 

they aren't and don't operate like bailiffs down south of the boarder.

neither do the councils, by fobbing you of saying it's out of our hands etc etc.

shouldn't be an issue.

 

most Scottish councils as long as you make contact and don't operate a head in the sand attitude are quite ok once they know what and why this payment issue is going on.

 

take what ever paperwork you have 

if not ring them up.

 

how much is owing and when did you last pay the council anything?

Last time i had to take the time to pay directive to the court clerk to stop sequestration on my father's behalf.

The council office wouldnt deal with us saying only that we would have to let the court actions go ahead.

I think the debt on that occasion was around 15k. 

 

The debt on this occasion is only around the £400 mark. I believe it to be from the time i moved into my home till the time we got the council tax direct debit sorted out. Since then it has always been paid and outwith that we are up to date with it. 

 

Il go along to council tax office tomorrow and see what they say.

Just out from council tax office as it was closed here last week. 

 

Had a short chat with lady behind counter who told me in no uncertain terms, once debt has gone to sherriff officers then they cannot do anything about it, so i must deal with sherriff officers direct. 

 

Should i now be looking at sending in a Time to Pay order to court?

Not true, 

 

Local Councillor will be able to sort you out with an affordable repayment programme. Contact details should be on Google.

Moray Council do say on their website they will not deal with you once the debt has been passed to Scott & Co.

Some years ago I was due Edinburgh Council over £6,000 for Council Tax arrears and was almost sequestrated.

It was Scott & Co I had to deal with, I came to a repayment arrangement with them and eventually paid off the debt.

 

For £400 I cant see them being too difficult in coming to an arrangement, just remember only offer them what you are sure you can afford and try not to miss any payments.

Havnt received a reply from councillor. Il give it till tomorrow lunch time.

 

If i dont hear from him, then im guessing im just gonna have to pay scott&co the debt plus their charges?

Give councilor a bell today then. Normally their mobiles are posted and can be found with a Google search.
