A festive good morning to you, 

Received a parking charge notice from Premier Park Ltd... For Parking and Leaving Site at Markham Retail Park, Chesterfield.  I havent responded to the notice yet.  I did leave the site for 5 minutes on foot , to call in to a shop on adjoining Ravenside retail park, but then returned to shop on Markham retail park as planned.

Could anyone please advise me of how to proceed, as I wish to contest it.

Date of the infringement. 14 December 2019

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date]

[scan up BOTHSIDES as ONE PDF- follow the upload guide] 17th December 2019

 

3 Date received. 20th December 2019

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?]. Yes

 

5 Is there any photographic evidence of the event?  Picture of car stationary in parking space x 2

 

6 Have you appealed? [Y/N?] post up your appeal] No 

Have you had a response? [Y/N?] post it up No

 

7 Who is the parking company? Premier Park

 

8. Where exactly [carpark name and town] Markham Retail Park, Chesterfield

 

For either option, does it say which appeals body they operate under.No

no such things ofcourse..they can't enforce trespass anywhere.

 

I will guess these were spycamera pictures not ANPR

and no windscreen ticket was issued 

so their NTK is issued too early anyway too.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

this is a common occurrence and an abuse of the POFA as well as breach of the GDPR.

there was nothingt o stop them issuing the driver a notice at the time but they dont, they prefer to go for a strange sort of entrapment and as their pictures they show you dotn have any detail fo the suppposed event that caused the breach they ahve failed to follow the protocols of the pOFA to create a liability. they may well claim to have pictures of someone wandering about but basically so what, that loses them their claim as well.

Ignore them and their pet dca's until such time you get a letter before action or letter before claim. In the meanwhile get some pictures of the car park, signage, and route through to other retail area so we can advise on best way of beating them off when the time comes.

Greedy and dishonest so they wont be dropping this in a hurry but will once they knwo they are rumbled but show your hand too soon and they will make up something else and try their luck again
