?/BW windscreen PCN claimform - Employee hospital parking

My mum works for the NHS and was parked in an allocated bay for employees, however she received a parking ticket.

 

We disputed this and it was declined and has now been passed to another company, bwlegal I believe.

 

We asked for photographic evidence and the date on the photo was Jan 2015, however the ticket was issued on jan 2016.

 

We didn't own the car in 2015, and my argument with the company is that the evidence didn't match the date of the supposed offense and if we were to goto court, the court would throw it out because of inconsistent dates...

 

Bwlegal state that it must have been an error on the camera and that the payment is still due, I said how can it be, it's like me placing you at the scene of a crime in January 2016 but my evidence shows Jan 2015,the court wouldn't accept that evidence ,they said we will still persue the debt and the amount will keep increasing.

 

Out of principle we don't wish to pay as my mum was entitled to park there however they have rejected those grounds and even if her boss writes to them they say not possible to appeal...

 

Any advice would be appreciated.

Is she in a union ?

 

If so, I'm sure the union rep (and central office) would have a field day with this.

I don't think she is, however I will check.

 

I would have thought regardless of whether she is in a union or not we should have a case....?

Hello there.

 

BW Legal are all over the private parking forum at the moment threatening people. I'm sure the guys will help you to resolve this though, we never advise to pay.

 

Just to be clear please, you're in letter tennis at the moment but haven't received any court papers?

I would do nothing and let them hang themselves.

If you tell them they are wrong now they will just alter their "facts" to suit the circumstance.

 

It will take a bit of nerves but ultimately waiting for them to issue a claim will be the best course of action as they wont be able to backtrack then, just drop the matter or lose in court.

 

 

Either way, the parking co will be poorer for it and may well learn a valuable lesson about BWL.

 

Stop writing to them.

in this instance

all BW is acting as a DCA

these have no such legal powers

Yes employee supremacy however they are saying no badge was displayed and again their photos aren't clear enough to confirm no badge was displayed...

but they wont tell you that,

you write to them and they will make the assumption that you will pay up if enough pressure is brought to bear.

 

 

These are not honest brokers.

 

Keep writing and telling they have got the date wrong and they will alter the evidence to fit their case.

say nothing and they cont fiddle things

Hi

 

My mum works at a NHS hospital and was parked in her car park when at work.

 

The car parking company sent her a ticket which she said contested as was entitled to park there etc, the more she called the more letters they sent. 

 

After a while she stopped contacting them and they stopped...Then a year later she got a demand to pay...She then requested a photo of her car etc, they sent a photo with the wrong date, which is different to the date on the ticket...The date on the photo is before she owned the car. 

 

She again didn't pay as told the debt collection agency she doesnt agree with the ticket as she was in her allocated bay.

 

She has now been sent a county court letter where she needs to either pay, or fill in some papers to defend her case...

 

As their evidence has the wrong date, could the court throw it out as we can prove we didnt own the car on the date of the photo and because the date on photo doesnt match the ticket she got?

It would be helpful if you started by telling us which company you are dealing with and also which hospital.

You say that you have been sent a County Court letter. I imagine that you mean that you have been sent a claim form.

 You should immediately send an acknowledgement and that will give you 28 days in which to put in a defence.

On the basis of what you have said, it is a cut and dried case then you shouldn't have any problem
