My daughter has been unsuccessful with PCN appeal and would like a bit of feedback with the evidence uploaded.

 

thee signed contract states only 2 hours free parking when there is 3 hrs. 

 

They supplied pictures of signs dated and then the sign is missing or changed position in an other.

there summary of the violation states that payment by phone as on signs but you are not able to pay for any parking.

 

on the day of violation there was a workman fitting signs and the parking company have accepted that signs we're being adjusted.

 

the landowner is Cornwall council and leases it to GLL leisure. 

 

My daughter is a university student but won't leave the house as it's now worrying her a bailiff will turn up.

whats the best recourse the company shouldn't get away with blatantly supplying false information.

please could someone give a little advice

Knowledge is power, these fleecers try to scare people into paying up monies they don't owe, because people don't know the law.

 

The only way bailiffs could be involved is if

   - the fleecers sent a formal Letter Before Action to your daughter

   - then started court action

   - your daughter lost the court case

   - your daughter refused to pay what the judge ordered.

 

She's not even at stage one yet!

 

Try to think through things logically & legally.  If these conmen could just sent the bailiffs round to your daughter on a whim - then she could just send the bailiffs round to them on a whim!  There has to be more to it.

Could you supply more details like date time location,  Is the Council the ones who issued the ticket?  If so the process is different.

We could do with some help from you.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

 we need the whole story and ideally from the horses mouth. We also need to see what she has received  and what she has said in her appeal.

Who is the parking co and has she just appealed to them or to their trade body's "independent" appeals service as well?

 

Pictures of what was there (ie google streetview if no available elsewhere) and what is there now.
