Hi,

 

I was recently involded in an accident, in late 2018, where a pedestrian accused me of hitting her when I was reversing.

I did not hit her and I was arguing with her about it but she believed I did.

She filed no police report or call the ambulance, did not take down any of my details and she just went about her day.

(keep in mind I saw the women who claimed to be hit walking fine the next day)

 

A couple a weeks later I recieved a letter from a solicitor making a personal injuries claim.

Of course what followed was a call from XS Direct.

I told them I did not hit her and she was lying.

But they sent an inverstigator and I said the same thing.

 

I did not recive any corrospindent from XS direct for over a year about the accident (they even sent me my no claims 1year bounus email) .

My policy has been over with them for at least 6 months. 

 

randomly, I received a letter through the post saying that I have to pay £3000 for all section claim.

They send me a brief breakdown which states that the personal injuries came up to £4000. of which £3000 I have to pay.

 

I just wanted to know is there a way of me beating this or am I stuck with a £3000 pound dept at the age of 21 that I can not afford?

should not have been the only comms you got over this

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Click the link that “SAR” has created in your post, for the info on the SAR.

 

If you can’t afford a £3000 excess, why did you take out a policy with a £3000 excess? That is quite a gamble, and one you aren’t certain to win if the claimant can produce evidence .....

I didnt even know I had an All Section excess as I did I through a broker who did not tell me I had a £3000 excess at the time. This was my first insurance I was not privey to how insurance work. If I knew then of course I would not have taken it.

Did they send you policy documents?

with a letter saying “read these and ensure the policy meets your needs” 

 

If they didn’t you might be able to claim mis-selling.

If they did, and you didn’t read them (/ read them carefully enough!) : that’d be mistake number 2.......
