Hi

 

I hope that everyone is coping well :)

 

We received a message a few months ago about mediation, we called back and there were no slots left so the case went to the courts.

 

We have received a letter today;

 

1) Unless the claimant does by  4:00 on 19 June 2020 pay the court the trial fee of £25 or file a properly completed application (i.e. one which provides all of the required information in the manner requested) for help with fees, the the claim will be struck out .....

 

2) The hearing of the claim will take place on 17th July at X County Court .........

 

3) Parties serve and file copy documents by;

 

Claimant 10th June

 

Defendant 24th June

 

I am surprised that courts will be back in person in July but we will get started on the defence statement.

Our issue is that we are supposed to be on holiday on 17th July,

this is unlikely to go ahead but will let the courts Know anyway.

eh? the claim was stayed in January was it not?

so you received an N180 since Jan?

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

get scribbling but dont send anything yet.

 

They have to file more than a week before you do so you will have the opportunity to pull their WS to shreds before they can see yours.

 

They also have to gamble whether to pay the money and thus giving you the opportunity to go for a costs order if the claim is rubbish (it will be) before they get a chance to tell a single lie in person.

 

IF you had kept us in the loop you might have had this put to bed by now as snatching at mediation will have emboldened them and also delayed things.

 

There is nothing to mediate, it is not like a dispute with your builder where he has done some rubbish job and you have part paid and each want something,

 

you dont have anything to negotiate unless you want to try paying them just some of the money and if that is the case you need some law to support that and if that law if there it will also show that you owe nothing anyway so why negotiate away your rights?

Yep, I wonder too, especially as we have someone new in the same boat and it would be very useful for them to know.

We could do with some help from you.
