In the same position, bought car from dealer May 2018 set up DD only for DVLA to cancel 12 months later due to no registered keeper. Their website says you can not tax a car without registered keeper. Have complained via their procedure ( still ongoing) but they still want to take me to court for penalty £93. Have had a reply which states their system allows for third party to tax car and that there is no requirement for a registered keeper.
So if no keeper needed why not continue with DD?
Once resolved you might well be looking at some form of compensation from marstons and the previous supplier, but best option to resolve is to follow BankFodder's advice. Marstons would assume the energyco were correct with the warrant so in a way they are as innocent as you, they merely acted on the Warrant issued by the magistrates Court. Might be GDPR issues if the previous supplier gave third party debt details to you also..
They need to send a proper Letter Before Claim/Action giving 30 days along with Pre Action Protocol forms, which you ignore and send an ericsbrother snotty letter instead to the tame solicitor that sent it. DRP are not solicitors so I would ignore it
ok so received letter from DR+ again today but this time they mentioned that they have advised MET to now take court action against me to recover the amount outstanding. They also mentioned that to avoid the cost and inconvenience of court MET has proposed to extend the payment deadline for a further 14 days means I should pay the outstanding amount by 05/02/2020 or can set up three months instalment plan before this date.
At this point the only question I have is when this goes to court are all the communications will be through letters or will there be scenario that I may have to go to court? the reason being It's hard to manage in busy life so it is important for me know this.
Yes, I think that returning the male would have been a very good idea and you might have avoided this problem. I think that when people look at this, they may point this out to you and I'm not able to disagree with them completely.
