Mike Dailly: It's not fair for councils to charge Disabled People

LAST WEEK I spent a couple of days in Scotland’s supreme court, the Court of Session, arguing that a policy charging disabled Glaswegians for community care services was discriminatory and unlawful.

 

I won’t say anything more about this as the judgement is expected next week. It’s the first such legal challenge in Scotland as far as I am aware.

 

All of this got me thinking about how local authorities take money from peoples’ disability benefits. Is it fair, equitable or just to do so in 21st century Scotland?

Just to add for those that may not be aware Glasgow City Council is the Largest Local Authority in Scotland and most of the other Councils/Local Authorities in Scotland take direction from Glasgow City Councils actions/policies etc.

 

I can say this as a veteran who fought Glasgow City Council for almost 3 yrs as they were classing one of my Forces Pensions as an Occupational Pension when it never was as I was Medically Discharged after 18 yrs service.

 

Who lost Glasgow City Council did and the War Pensions Agency were happy and shocked at my treatment I was invited to the very first WPA Forums and met the WPA Director and heard other veterans horror stories.
