Good Morning,

 

I have recently received a Parking Charge Notice by CPM UK Car Park Management for a short stop on Trinity Park Roadways, Birmingham.

 

 I pulled over for about 15 mins,  While I was there I took a phone call.

 

 I didn't notice any signs saying I couldn't pull over and stop and I didn't ever leave the car.

 

Any advice would be welcome. Should I respond ' without prejudice' saying I am refusing to pay??

 

 

1 Date of the infringement 6/10/19

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 10/10/19

 

3 Date received 14/10/19

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Y

 

5 Is there any photographic evidence of the event? Y

 

6 Have you appealed? [Y/N?] post up your appeal] N

Have you had a response? [Y/N?] post it up N/A

 

7 Who is the parking company? CPM UK Car Park Management

 

8. Where exactly [carpark name and town] Trinity Park Roadways, Birmingham

Don't worry, there will be similarities but each case will be different in some way  so you are best having your own thread to advise on your particular issue.

the NTK isnt compliant because it doesnt have a proper address for the service of documents on, just a PO Box number.

now that may invalidate the NTK but has never been tested in court and i doubt that 50% of judges will chuck a claim out on just that.

 

however, "no parking" isnt an invitation to park under the terms offered, it is prohibitive and you cant agree to a contract that is only formed when you break it
