    • On the first point, yes, but I now know that the "traffic building up beyond my control after I entered the box" is not an acceptable defence due to the rules.   Re second point, well I *did* have to break suddenly, otherwise I'd have hit the black car in front of me. I understand now that this is not "defence enough" on the contravention.   Re loophole on pics/video: I read in another post somewhere (not sure it was here or someplace else) that your reg must be clearly seen in the pics/videos at the *time* it's committing the offence ("captured live" I think it was the expression used) and that it's not permitted for someone to go over the footage in order to zoom in your number plate. So, what I'm saying is: from the pics/video (except the really dark pic that's zooming on my reg only), you *cannot* see the reg of my car. Hence why the pic zoomed on my reg doesn't show the full car *actually commiting* the offence. They're trying to *infer* that it's my car. (*I* know it is, but don't they have to prove the offence actually being committed by *my* car with pics that show the full car/position *and* reg? aka, not just a random zoomed in pic that could've been anywhere, hence the argument about "not being allowed to go over footage in order to capture offence/details").   Thanks for your time in answering btw ☺   P.S.     • Hi   Robinson Way are still chasing on this saying its not statute barred, but another issue has come to light since submitting a mortgage application.   CL Finance have a second charge on the property for this from ~2012, which the mortgage lender want removed before making an offer. CL Finance Limited (Company no. 01108021) was dissolved in October.   Does anyone have any advice on how i can have the charge removed and how we can stop Robinson Way chasing.   Many thanks   Dean

We have cancelled our Direct Debit mandates and now realise that we did not provide 30 days’ notice needed. I therefore offer to pay the outstanding £49.98 for the notice period, consisting of £24.99 for ********** and £24.99 for *********.   I will pay no administration or cancellation fees and no further membership amounts. Hence the contracts are terminated and we will ignore any further demands.     Yours Sincerely,"   Interestingly (and more than likely irrelevant) the email response from DFC stated that they wouldn't deal with me regarding my partners membership due to data protection, but then they also named her in the email! Surely a breach of data protection in itself!   Thanks Buddy2015

Natwest Not Refunding ATM Error **RESOLVED**

Hi

 

I tried to take £120 out of a Barclays ATM using my Natwest debit card.  The machine gave my card back but didn't issue any money.  The machine made a noise like it was counting notes then stopped and a message popped up on the screen saying unable to issue cash please see card provider.  I had to get cash out of another machine near by.

 

However the money was taken from my account - I raised a dispute with Natwest of which the outcome was the ATM provider found no error and the bank wont refund.  I have complained to Natwest and they will not have any of it and told me to contact the ATM provider.

 

I find this very unfair as I have done nothing wrong yet they will not refund the money.  Any ideas on where I can go with this - many thanks

when this happens you should always approach the ATM company.

ok well I cant see asda not having had questions about this before 

go into them at their customer helpdesk

ask who to contact as your money didn't come out.

 

had this a few years ago and it wasn't until the provider of the ATM machine physically looked at the log of the machine that day 4mths after it happened and proved me correct that I got my £250 back

after being told by my bank not their problem.

I have contacted ASDA who have said they have no involvement with the machine and need to contact the owner who are Barclays - they could not give me any contact details.

 

I rang Barclay's who were no help whatsoever and could not give me a number to contact - they told me to check the contact details on front of the machine.  However there are no contact details on the front of the ATM.  There is only a sign saying ASDA have no responsibility for the machine and to contact your card issuer in the event of any problems.

 

I am going round in circles with this and think my only option may be a complaint to the FCO?

what do you mean by contacted asda?

 

please don't get me wrong but if it is in the premise or on their wall [which most are] they are duty bound to give you an address to write too.

did you visit the store or use asda HQ website?

Natwest have just contacted me and admitted they have made a mistake - they checked with the wrong ATM(the one I used a couple of minutes later)

 

They are refunding the money and have offered me £50 compensation so at least its been sorted - mnay thanks
