SIP operator photos PCN - Station Way, Basildon - but i've paid with proof!

For PCN's received through the post [ANPR camera capture]

 

please answer the following questions.

 

1 Date of the infringement 12/09/2019

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date]19/09/2019

 

3 Date received23/09/2019

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?]No

 

5 Is there any photographic evidence of the event?Yes

 

6 Have you appealed? Yes  Appealed to explain that I had paid thru the phone app, and uploaded an evidence of payment, thru a bank statement.

 

Have you had a response?  Yes, see below.

 

"We are in receipt your appeal against PCN ******. 

After reviewing the evidence and the information that you have provided in your appeal we regret to inform you that your appeal has been unsuccessful.

 

Your vehicle was parked in a manner other than in accordance with the signage situated at the car park.

For this reason the parking charge was issued correctly and the charge now stands at £60.00 to be paid within 14 days.

After this time the charge will increase and additional charges may be incurred"

 

7 Who is the parking company?SIP Parking Limited

 

8. Where exactly Station Way, Basildon

 

For either option, does it say which appeals body they operate under. IAS

Please be advised that further to our rejection letter, further clarification from the Appeals Assessment Officer is below:
 "Please be advised no valid parking session could be located for your vehicle therefore the PCN has been issued correctly. "
 Please refer to your rejection letter for further information on how to pay the charge at the rates advised within the rejection letter or how to appeal further.

"vehicle not permitted" - That sounds more like it's a resident/permit holder only area where there is no paid for parking, or you parked a bus/lorry etc when they had signs only permitting vehicles under a certain size/class. Am I reading that right?

ah the old vanishing windscreen ticket that they supposedly write out at the time of observation but don't attach to the windscreen at all.

 

so they shot themselves in the foot anyway as they've sent it by post within 29 days, claiming it was an ANPR capture when it was operator photos?

we need to see the FULL NTD bothside please

do not obscure dates and times just any barcodes, your reg and address/pcn /ref no.

If vehicle is not permitted how come the payment was accepted?

No need to ask them yet but get some pictures of the signage and the payment machine there just in case
