Good Morning 

I have just received a rather threatening hand deliverd red final notice from an enforcement agent probably from marston holdings for the sum of £243.75 the only info has on it is  reference number and client magistrates court i haven't had any dealings with any court claims recently.

It says he will be coming back later at 7pm

 

full payment needs or he will be removing goods 

 

I thought only high court enforcement could do that 

 

any advise would be appreciated

This is literally the first you have ever heard of it?

You have no idea what the debt could be for?

Could it be for unpaid Council Tax?

 

It's not my area of expertise, but the only debt enforcement I've heard of that involves the magistrates court is for unpaid Council Tax. 

 

One of the experts will come along and advise soon, but I understand from previous threads that there are different rules on enforcement when it's unpaid council tax, if that's what it is.

its says magistrates court

so cant be a consumer debt CCJ nor CTAX

 

it must be an old council parking ticket or traffic offence or a fine for something like rail travel.

If you have heard nothing whatsoever about this before, never received any paperwork at all, and don't know what it is about, the only way you can find out what it is for is contact Marstons and ask. You can't ask the court direct as it doesn't say which magistrates court it is.

 

It's odd that you never received any previous paperwork but that Marstons know where you live now. Have you moved recently? Could paperwork have been sent to  a previous address and when Marstons found you'd moved they tracked you down to your current address?

No I don't have any outstanding fines or parking fines speeding etc council tax

 

Not sure why he put Magistrates court on there with out any further info

 

I will call them 

 

its says previous notices and attendances 

this is the first visit !

 

can he return and remove goods ?

if its a CCJ there are no rights of forced entry

if it is a magistrates fine, then it is rare for forced entry to be given and they would have to apply for it directly with the relevant magistrates court

Hi

 

been in touch with the collections agent apparently its from an old court fine that i thought i had paid in full apparetly there was small amount of £8.75 still owing to Marstons 

they never once contacted me about the outstanding amount

they have now issued an enforcement amount of £235 to collect £8.75

 

I'm absolutely livid what an absolute shower  

 

is there any thing that can be done 

 

agent says i cant pay in enstallments and that he will charge me again to visit a second time not sure how that works

docs sorted to one file and redacted properly in post 9

 

you need to see a copy of the notice of enforcement 

as if it was not issued to where you live now

[i'e..does NOT have your correct current address on it

they cannot charge the £235 fee

only the £75 fee when you get the NOE to/containing the correct address

the correct address has been on all the documentation from the original court fine and from the DC

very reluctatly I have paid 

when i went on their web site and typed in the reference number it said the outstanding amount was the £8.75

when i spoke to them about this they said it takes 24 hours for the web site to up date with the new £235 fee because of the visit today from the DC

 

can I try and claim it back ?

If you mean BAILIFF - a Debt Collector [DCA] is NOT A BAILIFF never confuse the two

 

so long ago you did have a NOE 

and now you've had the enforcement visit hence the £235 added

can't see how you can get out of that sadly

 

bit of a shame for only £8.75.
