    • Hi   With a SAR all you have to do is ask for 'ALL DATA' (this way it does not matter what format they hold that data whether it be digital, email, telephone calls (recorded), written etc).   They then have 30 Days to comply once they have acknowledged your SAR Request (that is unless they require ID Verification) which the 30 Days time limit does not start until they have verified your ID if requested)   Also can I add in DHL response in post#36 I hate it when any Company/Business etc. has the nerve to use the get out clause of 'Human Error'.    This is not the case as it was 'Maladministration' by DHL' not 'Human Error' as stated to you, irrespective of who/which employee of DHL made the 'Human Error' the buck stops with DHL as who/which employee made that error was Employed by DHL.

[if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked   goto the defence filing section  file the following:     1 The Claimant's claim was issued on (insert date).  2 The Defendant contends that the Claimant's claim so issued is a claim in contract and is statute barred pursuant to the provisions of section 5 of the limitation act 1980.  . If, which is denied, the claimant contends that the Defendant is in breach of the alleged contract, in excess of 6 years have elapsed since the date on which any cause of action for breach accrued for the benefit of the Claimant. .  3 The Claimant's claim to be entitled to payment of £[insert figure from their POC]  or any other sum, or relief of any kind is denied. .. ..ends..   dx          
    • I passed on the article and link to friend. Between us we will now try get the required info to the correct location so that they (whoever in the Govt) can sort out what he is owed.     • Well I would want my £50 back also but hey ho if your satisfied its been resolved.....there was no way you could ever be liable anyway as your contract was with TC not RC.   Thread title updated.   Andy

Hi 

 

I've received a PCN 74 days after alleged contravention.

On PCN they have vehicle noted as unknown.

 

Seriously can they issue a PCN this long after contravention

What's the contravention, some sort of moving traffic offence?

 

Is it a hire or finance vehicle?

 

Whose name and address is on the V5C registration document?

It was a no right turn by cctv camera and V5 in my name at my address

Owned 

The PCN was the day after I bought the vehicle

I changed ownership on day of purchase online - V5 online

I suspect that the DVLA had not updated their records by the time the council applied for details of the registered owner and therefore the pcn initially went to the previous owner.

 

The date the DVLA actually updated their record is on your V5c under Doc Ref:

 

Presumably the previous owner made reps that they weren't the owner at the time of the contravention.

 

Once the council were satisfied that the previous owner wasn't liable , they then issued the pcn to you, which they are allowed to do and the normal 28 day limit for service does not apply.

 

All of that takes time which will explain at least most if not all of the 74 day delay

 

I suggest you register at pepipoo.com. Don't use a hotmail email address. They will need you to post any documents/pcn you've recieved

I have checked the V5c has the date of purchased.

So the car was registered to me.

 

So the delay was not down to dvla giving them incorrect information.

 

Appeal ???

On your V5c .

Section 9

Doc Ref No is 11 digits followed by a date. That's tte date the DVLA updated the change of ownership.

If the council asked the DVLA for details on or before that date they would have been given the previous owners details. It's all done electronically.

So the council are just trying it on then as document date was before the contravention

Are you sure you are looking at the doc ref date and not just the effective date of transfer to you (ie when you bought it)?

Ok so. Totally confused now.....

The date below doc ref is also acquired date.

 

I'm reading this from the box right hand corner of the first page of V5

 

 

😕 On the inside log book your right 😮

On the front it says date of purchase in  but inside it has a date that's 13 days later 😲

 

so ooops I appealled them today 

 

Under section 2.4 9 of code of practise of operation of CCTV 😕

 

i even checked there had been no delay in DVLA providing information.

Letter from  local authority today.

Both tickets cancelled due to an administration error!

 

Code of practice is worth check, I think, before any  considering payment of these CCTV issued tickets
