    • Absolutely normal.  They do their best to waste your time and also the time of the courts. It doesn't cost them anything.  It costs you and it costs the taxpayer so what do they care?   These are all the reasons why you should not agree to mediation but insist on going to trial.  They will continue to waste your time right off until the trial date and then probably make you an offer.  At least then it won't be in confidence and you can tell them to go and do one if they don't offer you 100% of what you are claiming

    • Just an update, finance company rejected my complaint saying they've found damage but can't tell when it's from even though I've shown them how the front end is misaligned in the advert photos compared to another identical model car they're selling.  Dealership now want to charge me to get the car brought back to me but will only discuss over the phone which seems off. They're also saying no damaged was picked up by JLR main dealership before I purchased it but my local JLR dealerships till this day haven't mentioned the damage to me because they don't go into stuff like that for some reason lol  Ombudsman case is still open, not sure if I should leave the car with them or just pay to have it brought back.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was caught shoplifting today at Superdrug

they came to get me and they sat me down, took a photo of me and said I was banned from all Superdrug stores and savers stores.

they wanted my national insurance number which I couldn’t give them because I don’t know it 

they also said I would be fined and a letter would be sent confirming this. 

 

I have been told different things about this;

that it will/will not be on my record for long

that I will have to / can ignore all letters addressed to me from them 

 

help??

it was an eyeliner - less than £10 in vaue

the police were not and will not be involved

so it cant be a fine.

Envelope? I haven’t had a letter through yet so i don’t know - will get back to you once i know what it looks like

 

@ericsbrotherI don’t know the guy that took me back into the shop looked like a normal dud so i would assume a shopworker

 

i also don’t know what legal stuff would go on.... thats why im here asking 

what do i do

im not sure how this answers my question, yes i will read some more threads... but i was wondering if there were any credible sources that back up the theroy of leaving the letters alone

You came here for advice, soem advice has been given adn you question the validity and source of that advice.

We are all lay peopele, ie not giving professional advice but it is based on experience of the world and in some cases working in the field that advice is given on.

Now you dont have to take our advice, we wont get the huff if you prefer to look elsewhere or do something else.

when I asked what you think they would do with your NI number it is to prod you to think for yourself and question why they would ask for this when there is nothing legal they can do with the information so wouild you be wnating to give it to them knowing that they would want it to break the law if they processed it. Now you can take that up with the company at the top but TBH unless you want to spend money on a lawyer they will not answer the question or fob you off with some ridiculous answer anyway.

 

so for the moment read a lot about  RLP and similar situations to yours ans make particular note of what happened to the peopel in the end. You will find no threads theat ended by saying " thanks to you I gor sued by RLP and owe them a fortune". It isnt going to happen and the reasons why are explained in many threads. They rely on your feeling of guilt to get anywhere
