Hello

 

This is the first time I have been in as I've only just been able to change my handle to make myself a bit more anonymous.

 

I'm well down the road with Barclays. Court date set for Feb 13.

 

Need some help. I have to file all documents with the court and Barclays by Dec 1. What do I need to file with them?

 

Also, in their reponse Barclays have crossed off a couple of earlier payments I made to them as they are just over 6 years previous to September when the action was launched (they were indate in June when I first wrote the letters). But since then they have taken a couple of new payments (UKL 30 a time for going UKL 15 O/D) . So do I do a new spreadsheet and add these on??

The 6 years date from when you first became aware of the unlawful charges and contacted the bank about them ie June.

 

You can't add charges taken since you filed without amending your claim

Ok I understand that.

 

Main question was, I have to deliver to the court and to Barclays by 01 Dec

 

1. All docs I intend to rely on in the hearing

2. A statement of who will be giving evidence

 

Anybody who has got this far - please let me know what docs to send in next few days ?

 

eg copy spreadsheet, statements, what??

The court bundle may look a little confusing, but don't let it worry you, You most probably wont have to use it in court, but at least it will show them how serious you are.

Thanks for all your help. Court bundle now prepared and goes off tomorrow.

 

Just for info my schedule has gone like this:

 

1. DPA letter sent 05 June 2005

2. Claim for UKL 1550 sent 17 June 2005

3. Ack from Barclays 21 June

4. Usual letter 'we explained our charges....' offering UKL 465 :smile: on the 12 July

5. I rejected that on 17 July

6. MCOL filed end July filed 26 Sept

7. Rejected by Barclays on 09 October

8. Case now set for Portsmouth County Court on 13 Feb '07 - all docs in by 01 Dec.

 

Will repost if and when any more heard. With interest/court fees etc now total beyond 2K.

A young man from Barclays informed me that

'We don't want to go to court, we'd like to settle. But we don't agree your interest figures' (These were got from Vampiress's spreadsheet) and reckon they should be about half as much as I was claiming...'

 

 

Anybody else having their figures queried? Have I just miscalculated the interest?

 

Progress though - I think....:rolleyes:

I think progress indeed.

 

If you're using the England Simple Excel spreadsheet, try opening a fresh sheet and input the figures again. Seems as though they are querying very few.
