      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Stringernicy here, still confused with this website.

Apparently I need a list of all charges made within a maximum of six years, to present to my bank [HSBC] as proof, unfortunately I do not have this information, being in this dilemma, how do I go about getting this info'?

Any help would be greatly appreciated.:-?

Welcome, bit of reading required as you have probably guessed!

You start by sending an SAR to your bank, they then have 40 days to send your statements which you can use wisely by doing even more reading.

hi everyone, stringernicy here. Ive just been reading a few threads from other members concerning non replies from hsbc, plus letters being sent from a certain mr bowden giving pathetic excuses for not complying with customer requests. Ive just sent my first letter requesting statements and are expecting the same response. This is worrying me a little as im starting to feel im out of my depth here. But maybe thats what they are counting on, so I will soldier on regardless, although the procedure does seem complicated, im worried i may miss some details out. good luck to all others dealing with this cowboy bank.

Welcome.

The procedure isn't complicated if you find out about it before you do it. That way you won't miss any details out.

 

Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later.

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen

 

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time

 

This is a self-help forum and you must be prepared to put in time and effort. It is your claim, your money and you cannot expect others to do all the work for you.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help

Hi And Welcome.

S.A.R - (Subject Access Request) requests can drag out the whole 40 days don't worry its a way of stalling the paying back of your cash.

If you want you can send a reminder letter at 28 days explaining the time they have left. this shows you are being fair.

 

Keep on moving forward and each step should map out OK.

 

Make yourself your V's thread in the main bank section and you will get more feedback.

Hi again every one, just pointing out, please do not send me any more congratulations on my win. The point being I have not won anything. The win was claimed by bazzlad who I was merely congratulating and asking a little advice from. I neglected to change the reference heading. I do need some advice though. I sent my sar to my branch along with the fee on the 19th oct 06. Please could you tell me if I sent it to the wrong place. It was not sent recorded or by special del neglectfully.

do you have access to internet banking at all? you can get all 6 years statements and its a lot quicker

HSBC - 11/9/06 - prem letter sent

19/9/06 - lba sent £3391 requested

5/10/06 - MCOL

17/10/06 - offer for £1600 on one account recieved

28/11/06 - Full offer recieved

 

Capital one - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent for £640

 

Lloyds TSB - 13/9/06 -letter asking for statements sent

17/10/06 - prelim sent fro £732

Lloyds TSB - 26/9/06 - prem letter sent - £391

Hi everyone, Stringernicy here,probably in the wrong place on the site but never mind. HSBC recieved my sar on 19th oct, I recieved a letter from them today 30th oct, acknowledgeing my request for statements. I was surprised to see my £10 cheque returned and to be informed they will gladly cover the cost.

 

They also informed me that I shall shortly be recieving the said statements in separate batches. Im wondering if this is normal.

Although many of our systems are automated, a "manual intervention" by HSBC staff may be required in a variety of situations including, account opening, dealing with correspondence or telephone calls, when deposits or withdrawls are made over the counter at our branches and from time to time during account administration. Pus they've offered more info if I need it. How exactly does manual intervention affect my pending claim, Im not sure what it means. any info anyone would be most useful.:?::confused:

Don't worry, HSBC dod EXACTLY the same thing for me and I received all my statemnets in batches within 10 days. I think this is pretty normal mate.

25th spetember - Sent off S.A.R - (Subject Access Request)

10th October - Received all statements

11th October - Calculated all charges

Drafted prelim letter

Did spreadsheets

16th October - Sent prelim letter to Ian Shepherd

17th October - Letter delivered. 14 days starts today!

31st October - LBA sent first class recorded!

2nd November - Confirmation LBA received

18th November - Filed my MCOL for £1278. Bosh!

20th November - MCOL acknowledged

24th November - Acknowledgement of service

24th November - Received offer of £900. Rejected

30th November - Received offer of £1023. Rejected

Hi! Me too!!! They returned my £10 cheque as well!! Can't wait to get the statements and get things moving!

 

One thing, I sent off the SAR for my account and my joint account, but not my credit card. Should I write back and ask them to send me the CC statements too, or send a separate SAR?

HI ALL, This may be a daft question but when a direct debit is due and there are not enough funds to cover it, so the bank pays the d.d. and then charges me, will this charge still be owing to me through my claim? If anyone viewing this has an answer, I will be most grateful.:confused:

I recieved my first batch of statements today, 2.11.06. They have sent me 3 yrs worth so far, I was told in the acknowledgement letter dated, 26.10.06, that the statements would be arriving in separate batches. The ones I have are dated for the last 3 yrs so Im still waiting for the ones for the previous 3yrs.

So far they owe me £3653.00. This is without charges that I have already been informed will be added on the 14th of nov 06, another £125.00. This is also without interest, which I am puzzled by. There are amounts of interest on the statements marked immediately before the amount charged, unfortunately I dont know if this is interest caused by the overdraught charge, or if it is just general interest. How do I tell the difference?

 

There are charges marked for missuse of card, can I claim these back?

Any advice from other users who have maybe progressed further would be most appreciated.:)

could anyone help me please, im trying to enter my details on a spreadsheet.

1-Ive never used a spreadsheet before.

2-I cant find any help on that part of the site to assist me.

3-I dont know which sheet to use.

4-Im at preliminary stage so i know i dont claim the 8%apr, but im not sure which int to claim, contractual or statutory. Im completely lost.

5-Im finding this so stressful im thinking of giving up.

6-I hate computers, completely beyond me.

Please if anyone has some advice,I welcome it.

yeh i downloaded that spreadsheet (english excel) and it offers the added 8% interest figure,but as i'm sending of my initial request for unlawful charges didn't think this 8% could be used untill it gets to court level.DONT GIVE UP,i'm a tad confused but if its only "total charges" (HSBC) that i claim then thats more than nought.

I've put all the figures in and it very cleverly worked it all out, however, it has also showed me the 8%, so I am gonna send the whole thing off anyway, but only claim the amount, without the interest, on the letter. Does that make sense? I dont think it matters if the bank sees the added interest figure, they know you are not claiming that amount by reading the letter. Anyone know if I have got it wrong ??

I have noticed that a few people have done the spreadsheet that works out the 8% statutory interest, and printed that off.. then also edited it and printed it off without, for the first stages (pre-lim, then LBA). You can then photocopy them and file them for future reference.

 

 

It does seem complicated at first, but by reading around the site (FAQ's AND other peoples threads) it does become much clearer - I'm also just starting and the more I read, well, things just click into place.... :lol:

 

There is alot of help here too from the mods and from other users, so you will be fine. And those spreadsheets are brilliant!

Are you using the Excel spreadsheets? If so there's a tab at the bottom, one with the 8%, one without, you need the one without for your prelim & LBA, the one with for your court claim.

 

Sorry, If you're using the Works one, I don't know how they work.

hi every one, i hope your'e all progressing well. I have a question if anyone can help. If the bank has placed a default notice on my acct, am I right to assume this means that overdraught charges are automatically debited from my acct without any manual intervention. Also would the default cover any failed D/Ds etc. Im asking as I am about to send in my prelim request for return of money, and I need to know wether to include the section involving defaults. I couldnt find anything in the faqs about this, but thats probably because ive missed something. any help will be most welcome. GOOD LUCK TO YOU ALL. STRING!!!!:)
