Old Attachment of Earnings issue

Many years ago I got a debt and to cut a long story short ended up with an AOE order

- this is no longer on my credit report but a sum still comes out of my salary every month.

I'd stopped worrying about it - my current financial position is healthy.

However I am annoyed because something has happened and could do with some advice on how to proceed.

 

I am currently paying the money to an outfit called Stevens Drake

- I then received a letter from drydensfairfax saying they had taken over the debt.

I just ignored this thinking they would sort the transfer payment between them.

 

I have now had a further two letters from drydensfairfax saying that I make future payments to them and court action will be taken to recover the balance of the debt.

 

I emailed Stevens Drake for clarification twice asking them for a statement and to instruct my employer to stop making the payment as the debt no longer belonged to them. I didn't get an answer

 

- I emailed a third time and got bounced

- reason they had blocked my email address which really annoyed me

- they have my home and email address and didn't inform me any of this was happening.

 

I'm lost what to do here as this was a court order

- I can't just tell my employer to cancel the AOE

- or can I?

 

I've had no contact so far with drydensfairfax and don't acknowledge any debt to them.

 

Any help would be greatly appreciated.

Its for them to rearrange the Attachment of Earnings Order with your employer...so they have the legal authority to take the money from your salary.

I would show your HT department the letter and ask they stop and further payments to Stevens Drake with immediate effect.

 

The only action drydensfairfax can take is to reapply for the AOE in their name.....which they should have done when they took over the handling of the account.

was this a foreign debt?


please don't hit Quote...just type we know what we said earlier..

 

if everyone stopped blindly paying DCA's tomorrow

the biggest financial industry in the UK, DCA;s would collapse overnight.

No it was arrow global - it's from over ten years ago now

 

I ought to add I did get a letter from ARROW with notification of transfer - it said "our records show you have an arrangement in place and are making regular payments towards this account. There is nothing you can do at this stage"

 

- I read that as i'm unable to cancel the existing payment and must now deal with this other outfit as well.

Should I contact drydens fairfax informing them they need to reapply for the AOE - or ignore them until they serve papers?

the court will serve anything they may try not drydens...

until then expect increasing forest thru your letterbox

May as well and inform them that there is currently an AOE in place  with Stevens Drake which you intend to tell your employer to cancel .

Its up to them to set their own up which they may or may not.....as it requires a further fee.

 

But it imperative you stop the existing one ASAP as that money will be unaccounted for and gone forever.
