Shared drive issue

My mother's bungalow has a shared drive that runs between hers and her neighbours properties. 

 

Recently her neighbour has installed a new fence on his property which has encroached onto hers by a significant margin and is causing issues. At the time that the new fence was erected her neighbour informed of this but at no stage was it discussed nor mentioned that it would end up encroaching onto her part of the drive-as such we feel that it is a form of trespass.

 

What I need to know is what action, if any, can be taken to get this issue resolved and for the fence to be put back to where it should have been in the first place.

 

Do we need to go down the legal road and instruct a solicitor or are there any letters that we can initially send-if so can some one let me have copy of the template.
