Hi all

after a bit of advice

lloyds sold my two debts on and the new owners of the debts have supplied the agreements and terms and conditions under s77-79  but they have not supplied the default notices. If they want to start court action would they need to supply the default notices to enforce the debts

There is no requirement too under a cca request

thank you got your reply 

 

i had 2x debts with Lloyd’s  

1 was sold on to Intrum in November 2018 (credit card) and

 

the other sold on to Cabot July 219 (loan)

 

 done s77/78 on both accounts after Lloyd’s sold them and have received agreements terms and conditions and statement of accounts but no default notices.

 

Both Accounts defaulted in 2010.

 

I have been informed on another forum that cca changed the ruling in 2008 on what should be included in a default notice.

 

I think it should include s10a.from 2008 

 

As far as I am aware Lloyd’s did not carry this section in their default notices until 2012 so just asking if this could be used as a defence if they try to enforce the debts through the courts

Default notice absence can be fatal yes

But id be suspect of that forum tbh...

 

why dont you tell us the history of the debts and scan up the cca returns of each to one multipage pdf .

thanks for your reply

I am not very computer savvy so will get someone to scan and post up the agreements over the next couple of days.

 

These debts are not statute barred as I was paying them through a debt specialist firm from the time they defaulted in 2010 until 2017 when I done a s77/78 on them with Lloyd’s.

 

No response from Lloyd’s regarding s77/78 requests but they did engage DMC’s to chase the debts.

 

As mentioned in another post they then sold the debts to Intrum and Cabot who strangely have come up with the agreements. 

 

I have done a DSAR with Lloyd’s and both agreements show up

but not the default notices 

 

I do have reservations about the agreements and have put in a complaint with Lloyd’s

Would you say they have given wrong advice regarding the default notices

you seem to have initially for whatever reason I don't know

gone with one of these companies that claimed to be able to write off you debts?? and then got stung, realising you'd been had.

 

you then followed like advice from another forum, portraying the same theories.??

 

i'll bet the agreements are not enforceable.

get things scanned up but please to only ONE multipage pdf for each full CCA return you got
