Hi,

I have received a NTK from horizon parking ltd, however there was no windscreen PCN as per the driver, hence looking for your advise. 

Neither any PCN came in via post.

 

The first instance of me hearing about this PCN is via the NTK.

 

The car is always having a child car seat in the rear seat.

The reason for PCN, as per the NTK, is  Parked in Parent and Child Bay

 

1 The date of infringement? 10 Jul 2019

 

2 Have you yet appealed to the parking company yet? [Y/N?] no

 

 

have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days]

what date is on it ? Yes,  13 Aug 2019

Did the NTK provide photographic evidence? No

 

3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] No

 

5 Who is the parking company? Horizon Parking

 

6. where exactly [Carpark name and town] did you park? The driver used the Poplar Co-Op Car park

It could be either:

a) an ANPR capture (unlikely for a "parked in parent & child bay"), or

b) a "disappearing PCN" (where they put the PCN, but as a Parking Charge Notice, on the car, take a photo of it, but the NTD has miraculously disappeared by the time the driver gets back.

 

Either way, DON'T identify the driver, and if they want to reply on 'keeper liability', they are scuppered anyhow.

Well there's interesting. It's not like it's a disabled bay and they're saying you didn't display a badge. Perhaps you're meant to put a dirty nappy on the dashboard in a parent and child bay?

 

This is 99% a human being watching you arrive without a kid in tow, but did they stay long enough to be certain you didn't meet your partner inside and leave with the child?

 

What do the signs say? Can you get us some pics please?

Thanks Mrs Frog. The car park is far from me but i will try to gather some pics. I would like to get an idea, what needs to be done, after looking at the NTK?

 

Is there a reason @dx100uk says do not appeal ever?

The NTK does say that you were issued with a notice to the driver on the windscreen so was there a picture of it on your car? If they removed the NTD it would have been to prevent you from claiming the discount.

 

The NTK is not POFA compliant so do not appeal as that may reveal whether you were the driver or not. As it stands at the moment, they cannot pursue the keeper, only the driver so do not appeal or write to them. Just ignore them and all their unregulated debt collectors and legal guys also. The only time to get back to us is if you receive a letter of claim and then we will advise the next step. Usually a rude response.

 

In the meantime we do need legible pictures of their signs at the entrance of the car park and the position of other signs there especially those that differ from the one at the entrance. If there is a payment meter then the T&Cs on it are needed. 

 

Then check with the local council to see if there is planning permission for their signs and ANPR under the Town and Country [Advertisements] Regulations-they are often online thse days. No permission -no contract with motorists.

 

Incidentally even if you did not arrive with any children there is nothing that says you cannot park there to pick them up as your wife was already in the store.

OK I will get the pics soon from there and share here. The driver mentions there is no ANPR and has seen a traffic warden on previous occasions. Pretty sure he has generated the ticket after the driver left the car park.

no ...car park operator not a traffic warden ...its not a public street or council car park.

its private land

its a speculative invoice for breaking some kind of imaginary contract you signed upto with a private company, that most probably doesn't even have permission to tout there from the owner of the private land .

 

unlike a traffic warden that issues penalty charge notices that are court enforceable fines

Now the Co_op have had a lot of trouble with their car park management in the past so I would be getting on to their HQ and giving them some grief over this. If they dotn agree to tell the numpties to cancel Let them know that you will be asking for all of their CCTV and voice recordings of you and that will give them a headache just trawling through stuff to try and identify what is and isnt captured, not only there but at any store. Now knowing that you werent the driver at the time shouldnt put you off from being a nuisance. Tell the COOP HQ that Horizon are ignoring the law to issue their demands and that you will be going after the coop if the parking bandits continue to chase you as a co-respondent in a demand for damages for breach of the GDPR

 

the NTK isnt POFA complaint so dont be tempted to say anything to the parking co and by the way, it isnt a traffic warden, they dont exist any more and have never existed for management of parking on private land

try phoning the in Manchester HQ first, that way they can give you a quicker answer and if they say no then prepare a letter that rips into them, esp as it was clear that you had a child seat in the vehicle and the nosey parker who wnats to hang around their car park hoping to take pictures of small children getting in and out of cars needs to be investigated.

yes I would be insinuating there is something amiss until they can show that the person with the camera has got a current DBS advanced disclosure cert.. make them do the worrying
