      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

I am going to submit a claim with RBS for a PPI/loanguard which was added, as well as a life insurance which I was informed at had to sign up to when I got my mortgage with them.

 

Can I submit this as one claim or am I better to send them separately?

 

It was in 1997 but I have all the paperwork with account numbers, so should be ok?

Ok thank you, makes it a tad easier.

 

The first is called decreasing term assurance, have a policy number from 2003 and definitely had this as was a separate monthly payment.

 

Then an illustration of mortgage PPi from 1999 which I honestly don't know if I had or not.

 

For the 3k loan I have the 1996 quotation which shows 'optional insurance premium' of £301.00 included in the calculation and the monthly repayment of £208.65 which I recall paying just over £200.00 a month.

 

Shall I display it like this on the claim or just the ones I know I had?

 

Also which is the best template for this please? I had  look at the PPi consumer wiki one but wasn't sure if outdated?

 

The loan one appears to be a one off PPi actually:

 

Loan 3k

Admin £30.00

Optional Insurance Premium £301.00

 

Total credit £3331.00

 

Interest rate 18% back then.

 

done over 18 instalments.

 

does this make a difference or should I still do as one letter?

I would suspect if you scratch the surface all were paid to the same ins co.

its extremely rare for any mortgage agreement with multiple add-ons and PPI not to be so.

 

i'd lump everything together as one PCMPPI% figure and treat it all as PPI..

though it might simply pay you at this late stage [12 days to go]

to simply use the relevant mortgage providers website PPI reclaim link an wack on a simple claim now

then worry about the nitty gritty and calcs later

 

simply state you mis sold me PPI+LIFE etc etc

In xxxx I borrowed £X over 18 months which had PPI/loanguard added to it.

 

When I started my mortgage with you in 1997 a life assurance was added as a separate policy.

 

I also have a mortgage PPi illustration but am unsure if it was added.

 

Finally, tell us now why you are unhappy with the policy(s) that you purchased:

 

I didn’t know the loan ppi/loanguard was optional or that as this was added at the start of the loan I then paid interest on this as well.

 

I was advised I had to have a life insurance/assurance as part of having the mortgage and only recently learned this is not the case.

why are you not getting things after all this time?

is 'life assurance' PPI ... no!! so don't tell them..paint the impression that other were bolted on to the PPI else you'll only get the PPI back.

 

simply reply as I have stated and wipe out elsewhere if you said about the other insurances being life or whatever

they are NOT PPI so if you label them such, you cant associate them into a PPI claim. and you wont get a refund on them

please be careful upon words used throughout you submission

the fact that you had life ins is totally irrelevant to a PPI claim at this stage

Is it better to just submit the PPi claim now (as aware of time) for the loan and mortgage and then address the life assurance/insurance after then? if so I can just do exactly as you say in post 15 and wait to hear what they say.

 

If I use their ppi check for the mortgage side, surely that would delay it beyond 29th?

I am submitting this tonight, but I have just found the mortgage agreement!

 

It states in special conditions:

 

Payment protection insurance being effected by a person or persons (the insured) with the insurer and for an amount and covering all risks to the bank is a precondition of the loan etc...

 

There is also a mortgage loanguard leaflet which mentions Direct Line.

 

I guess this shows I did have PPi as well as the life assurance and didn't even realise?!

Hi all

 

Happy New Year!

 

Had a couple of letters from RBS now.

 

'They are prepared to uphold my complaint and offer £600.00 odd for PPI on a loan. This is £250.00 odd PPI and then statutory interest'. It gives a loan account number, but doesn't advise anymore. Should I just call and ask what this relates to only?

 

I now also have paperwork and policy numbers for:

 

Decreasing term insurance - life protector (which is still going ,with Aviva now, at £5.00 per month)

Mortgage protection plan

Quotation for loan with PPI added (which I know I had around that time)

 

How am I best to play this?

I called the RBS PPi line as want to get this moving and they advised the offer relates to a loan before, the mortgate started. I think the figures work out? 

 

2k loan 1996-1998 - PPi £250.00 and statutory interest £450, less tax gives offer of £600.00

 

Should compound be added to this also?

 

The other one, not mentioned by RBS is the mortgate protection plan, starting in 1999 about £7.00 a month which paperwork shows was until 2003 where I asked to surrender it and was advised it has no surrender value.

 

Other paperwork shows this changed to a Royal Scottish Assurance life protector plan which started in 2003 and goes until 2025. This is £5.00 per month and paperwork from 2011 when I had a transfer of business letter saying is now with Aviva and collects currently.

 

How I am best to approach this please?

only credit card ppi/charges are compounded.

if you've not already registered a claim for the MPPI/life ins (PPI in sheeps clothing) it is now too late sadly
