PRA Claimform - old LLoyds loan debt

Good morning all,

I'm after some advice in respect of the following,

 

I’ll try and recall the main points:

Original loan was with Lloyd’s bank many years ago.

in 2007 I set up a Payplan DMP, several debts, been paying them ever since without any issues.

 

Towards end of 2018, Payplan advises that PRA Group held details on file that were different from those held by Payplan, eventually found out it was that one file was in my wife’s name and as such they (PRA) would only deal with my wife and in April 2019, Payplan stopped paying PRA, at the time I was not made aware they stopped the payments to PRA.

 

On 18/07/19 wife receives communication from PRA advising the account was being transferred to investigations & Litigations dept, also enclosed were papers for my wife to complete about the debt and her finances.

 

my immediate thought was that as the payments to date had been made by me, and up to March 2019 had been accepted by PRA, I could simply advise that I will continue to make the payments direct, I can even pay the arrears. 

 

As I’m no solicitor or debt specialist would this be the way to go, my wife has no income and does not work due to her health. 

 

Looking forward to to some help/guidance, I have until 22/08 to respond.

send them a CCA request

as you should all these debts you've been blindly paying for 10yrs 


..

Thanks for the help DX,

I’ve been in hospital of late so not been around,

 

we recently received correspondence in which they have so far been unable to find the signed paperwork and have deemed the debt unenforceable and unless they obtain the signed documents won’t enforce it, although they do mention they can continue to hound us.

 

Today received a CCJ notice to respond to,

I have 28 days to respond,

do I need to send a copy of their recent paperwork and a response based on their failure to find the signed docs?

Hi Andy,

I completed the documents online,

unfortunately I had another spell in hospital which interfered with my schedule,

 

my response on behalf of my wife was that she never had a loan with Lloyd’s,

that she never paid anything whatsoever in respect of the alleged loan.

 

Today she received a one page response from PRA contents as follows:

”We write further to the above and confirm receipt of your defence.

We have written to the court and wish to inform you that we intend to proceed with our claim.

 

In view of the above what options/route should we take, PRA have never been able to supply any copy of the alleged agreement this refers to.

and can you post up the defence? that you filed? and the date from MCOL you filed it?

 

did you AOS, CCA and CRP? too

I have attached the documents and the extract from the MCOL defence,

also the correspondence I sent to PRA yesterday evening below(not sure if this will do anything).

Dear Sirs,

Claim No: XXXXXX3CM

I acknowledge your correspondence dated 11th November 2019, in which you:

A) Confirm receipt of my defence.


B) Advise that you intend to proceed with the claim.

 

1. You will recall that on 11.08.2019 I formally requested all information included any and all signed documentation pursuant to S.77 of the Consumer Credit Act 1974.

 

2. On 01.10.2019 I received your correspondence which indicated you were unable to provide the requested documents and therefore deemed the debt as unenforceable and not able to take court or further enforcement action against me to recover the outstanding balance. 

 

3. I received by post a claim pack Claim Reference XXXXX3CM dated 17th October 2019, indicating that you intention was to pursue the claim via the courts.

 

4. Using the MCOL facility I submitted my defence, based on true and factual information.

This action I took to comply with the required timeframe.

 

In the meantime I have dusted down all my records to establish the validity of your claim, taken council on actions and legal process and respectfully draw your attention to the following:

 

1) You have not to date produced the documents requested in my CCA request as per item 1 above.

 

2) The transaction extract you provided does not reflect what I hold in any form.

 

3) Unless you provide clear and legible documents to me, as previously requested, you cannot pursue this claim through the courts. Yet it appears that you have decided to take this course of action.

 

A copy of the above is also being submitted to the courts and I intend to seek further guidance on your actions as I believe you have failed to follow the correct procedure.

No...and I really dont know why you sent it to PRA....you have yet to get to disclosure stage of the process.
