Hi all,

 

I fell into the payday loan trap in 2015 and am now looking at doing something about it as it's becoming unsustainable due to moving house - Rent is now £1000 per month.  I had been paying a monthly amount of £66 through Payplan.  I'm also 99% certain I've an excellent chance of winning irresponsible lending claims with all of them... I remember back in 2015 Payday UK even reimbursed me £80 on their own merit, but only referenced one loan at the time (I'd had at least five or six with the amount increasing each time).

 

So, a couple of questions.  I have read the PDL reclaim guide so I have a fair idea of how to proceed but just need some early pointers..

 

Payplan currently have me paying the below ...

 

Active Securities (247 moneybox) £271.39

Cash on Go Ltd (Peachy??) £87.63

Credit Resource Solutions Ltd £177.43

Credit Resource Solutions Ltd £145.75

Instant Cash loans (PayDay UK??)  £572.64

Moneyboat.co.uk £218.90

Mr Lender £469.20

Piggy Bank £550.47

United Kash Ltd  (Different Money??) £122.45

 

Looking at my credit file, I can see that the below are listed ...

 

Evergreen Finance London Ltd (Moneyboat)  £219

Cash on Go Ltd (Peachy??)  £88

DJS Ltd (Piggy Bank??)  £550

Lending Stream £179

Lending Stream £446

Mr. Lender £869

Active Securities (247 Moneybox) £281

Instant Cash Loans (PayDay UK??) £587

 

I would imagine that the two lending stream accounts have been passed to CRS, but United Kash Ltd aren't even on my credit file - Should I disregard them entirely from this and wait to see if I receive any begging letters?

 

I am a bit concerned that the amounts owed vary, and some of the lenders don't appear to have been updating my account fairly.  For instance, whilst Piggy Bank have been updating the account as agreement to pay in green, 247 Moneybox have been updating my file as DEFAULT each month even though the total amount has been reducing.  My question is, would that be acceptable for them to do?  I understand the original agreement would have been defaulted on, but there has been an agreement in place - Surely a default is registered when there has been an issue with paying?  The other lenders appear to be recording each months payment either as an AR, or DM (Debt management plan).

 

Lending Stream have no record of me having ever made any attempt to pay off one of the loans, as the £446 loan listed on my file has been placed in default.  Why would that be, if I'm paying CRS under two accounts?

 

To get a fuller picture, should I initially SAR payplan?

 

Also, I see a lot of advice leading people away from communicating via e-mail - Why is this?  Surely an E-mail is a more efficient way of communicating?

you never use email as you need a papertrail

 

pers if your credit file was shot at the time etc etc

id send each lender an IRL complaint.

 

id also cancel Payplan totally.

 

the quicker you get a default registered on each debt the quicker they will vanish from your file.

So Peachy have responded and as expected have requested bank statements from the time, as well as my wage slip from the time.  All information they should have sought at the time I guess.

 

Does anyone know how I would obtain a snapshot of my credit report from that point in time?  If that is possible?

you cant and not your problem.

 

as for wanting statement/wages

they should have been checking that info at the time not NOW.

 

do not help them.

I'll be honest; I went through Resolver in the end because it's easier, it's all documented, and I can still go to the FOS at the end of the eight weeks if I'm unhappy.  The below is what they sent me ..

We are most sorry to learn that you have been dissatisfied with the service we have provided and can confirm that we will be conducting a thorough investigation of your concerns. Once we have completed this, we will write to you again.

To ensure we are able to adequately assess the complaint, we would kindly ask you to provide the following:

• Copies of your bank statements (for the period of your loan/s with us)
• Your payslips (from the time of your loan/s with us)
• Any additional evidence of your financial circumstances at the time.

The above will enable us to have a better understanding of your situation at the time and help in the investigation into your complaint.

We will assess the subject matter of the complaint and provide you with our assessment and our decision on it in no later than 8 weeks.

Please find enclosed a copy of our internal Complaints Procedure for your information.

Please take time to read this as it explains how we will deal with your complaint and when we will contact you again.

In the meantime, if you have any queries, please do not hesitate to contact us.

 

 

Additionally, I had a response from Payday UK asking me to vote in something called  'The Money Shop Scheme of Arrangement'.

 

From googling, it looks as though they're going under and £20milllion has been set aside for customer complaints.

oh dear resolver is a generic complaints platform and imho for financial issues a very big waste of time

Yes I did read that, but I don't have the time to send a load of letters and take them to the post office.

 

Resolver has helped me bedore and I dont see the issue really.  I can clearly see a case history, there's traceability and I still have the option of going to the FOS if I dont get a response I'm happy with.

Any advice with what to do with Peachy?  If sending them the data they requested is not an option.

 

Also, has anyone heard anything about this Money shop scheme arrangement?  I have until the 20th September to vote for or against it...

 

Piggy bank responded as well advising they would look into it and get back to me.
