Backdoor Prac/BW CCJ for old Barclaycard debt - got Warrant letter

Hi,

 

After some advise please,

 

I've recently been threatened with court action from Prac Financial Limited for non payment of 6.5k debt for a Barclay Card

 

I've never had a Barclay card and after checking my credit file it has no discrepancies to show there is anything owed?

 

Just wonder what my rights are and how to approach this now as I've only got until early August before they use bailiff to collect the debts!

 

I did a PPI check with Gladstone Brookes about a year ago and since then BW Legal started sending me these letters - all very fishy 🤔

moved to the BC forum

 

read the letter properly, it doesn't say WILL anything

and they cant send bailiffs around until/unless its been to court

you lose

you fail to pay in 28days

they go back to court and request bailiff action.

 

so what have you received...a letter of claim under PAP rules from BW?

sounds like they got a backdoor CCJ at an old address as you've obviously moved in recent years? and never informed your creditors.

 

go look at your credit file

see what it says.

PRAC buying CC Debts? My my... Thats a new one... 

Did you have a CC with another bank that became part of Barclaycard? 

 

Deffo gone for a CCJ - Check your Credit file and see if there is a CCJ.

How long have you lived at your current address... 

BW Legal have been known to mistrace and then secure judgement...

might be a jugement CCJ number on the warrant is there? its alphanumberic in format

I wouldn't worry too much about the warrant, there's no right of forced entry on consumer debts even after a CCJ is awarded.

and this one looks dodgy anyway, the court bailiff wont touch this with a barge pole once he knows

 

if you have the CCJ number on Monday [though is always busy]

why not phone up northants bulk and ask if it exists under your address

if it does ask for a PDF copy of the claimform and the judgement by email

yea might be better to get your ducks inline

or not..:bowl:

as the case maybe.

 

that way you know what wicket you are batting from and can deal with this is the correct manner

as pointed earlier, it surprised me too that PRAC/BW have an old Barclaycard debt that's not their usual fodder mostly PDL debts.
