I have just discovered this site and it is brill.

We have written to Barclays asking for them to refund bank charges and interest and we originally only asked for charges, to which they offered half but would not admit any liability. We then wrote back asking for the total plus interest and have heard nothing. My partner then wrote saying we would persue this in the court, but unfortunately did not give them a response time.

I have suggested he write one more time and give them 2 weeks to respond.

Firstly, is this the correct course of action?

Secondly, if I have been charge more money since, due to exceeding my overdraft and they have charged us £30, for each time something is paid that takes me over my limit, can we also add this latest bit to our claim?

Welcome to the site.

Firstly you cannot claim 8% interest before the court stage.

This is S69 so is determined by court.

Send them the letter before action (find this in the bank templates library )

Make sure you send a schedule of charges WITHOUT the interest.

Any further charges that have been applied since you originally wrote them can be added right up to filing for court.

You must read up more !

Hi Martin

 

Can you tell me what you mean by schedule of charges - my bank sent us pages and pages of statements for us to troll through, and we were able to identify all charges over the last 6 years.

 

Do we send copies of these with all charged highlighted?

There you are Ali now your own thread in Barclays.

No DO NOT send your statements.

If you do not want to use a spreadheet you can list the charges by eldest date first what the charge was for and the amount.

As you say there is a lot its probably more easier for you to use the SS.

Just another question before I start trying to fill in the sheet - what would you put as reason for the charge, if it is for going over overdraft limit? The bank normally pays cheques and DD's but charges me anyway, using the wording paid referral.

One other thing - I think I had better open another account quickly, but am looking for a student account, because I am starting Uni again in January.

If anyone can suggest a good bank to transfer for student account, I would be grateful.

Hi Guys

 

The bank were sent LBA with schedule of charges and given the obligatory time to reply, but they didn't so I submitted a COL. The fee was £80 - still it will be worth it to hopefully get a refund of £695 plus interest which puts it over £800.

I have been sent a notice of issue, and it says that the claim was sent to Barclays on 29th Decembner and deemed to be served by the 3/01/07

Barclays have until 17/01/2007 to reply.

Hi

I received Notice that Acknowledgment of service has been filed today. Not totally sure what it is all about. It is dated 9/1/07 and it says the Barclays have 28 days from the date of service of the claim form to file a defence. Can anyone tell me, is the date of service the original date the claim was sent to Barclays - 29/12/06; or the date it was deemed to be served as said in my previous post; or the date on this acknowledgement - 9/1/07?

I am a bit unsure.
