NPS PCN - 1 Kings Manor Newcastle NE1 2ST

I have received a Parking Charge Notice  for an alleged offence on 5th July, at NE12ST with a charge amount of £100 with an offer reduced to £60 if payment is made within 14 days.

can anyone offer any advice of action that I should take?

For PCN's received through the post [ANPR camera capture]

 

please answer the following questions.

 

1 Date of the infringement - 5/7/19

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 11/7/19

 

3 Date received 16/7/19

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Y

 

5 Is there any photographic evidence of the event? Y

 

6 Have you appealed? [Y/N?] post up your appeal] N

Have you had a response? [Y/N?] post it up

 

7 Who is the parking company? Northern Parking Services

 

8. Where exactly [carpark name and town] 1 Kings Manor Newcastle NE1 2ST

 

For either option, does it say which appeals body they operate under. BPA

 

There are two official bodies, the BPA and the IAS. If you are unsure,

please check HERE

 

 

I do not think there is ANPR at this location but there are photos of the vehicle in a parking space

The PCN has a "vehicle observed from"  date..... and time......  "to date..... time.....

thi sounds like operator pictures not ANPR so they've already shot themselves in the foot by sending the NTK too early [if you go back and read that link HB gave you.}

 

did you not get a windscreen ticket then?

I never had a windscreen ticket so this came as a complete - and unpleasant surprise today. I won't have access to a scanner for a couple of days but will upload asap (I'll censor identifying detail)

ho ho

the old vanishing windscreen ticket lark

 

its not an ANPR captures so sending the NTK before the 29 days is up

and getting your details from the DVLA under the guise it was an ANPR has broken every rule in the book.

 

but thats quite usual for NPS.

we need to see their piccies on the NTK to see if they have got it right or not. The idea that using para 9 is solely for ANPR is wrong but they MUST include any photographic evidence in the NTK and many dont do that but refer you to look on a website for them.

There is photo evidence. PCN attached.

Is it common to not put a ticket on the windscreen?

Should I send off the template as attached or is it not worthwhile?

I notice that on their PCN under the Parking Charge Amount it states

"    PAYMENT TO BE MADE WITH 28 DAYS OF DATE ISSUED: 11th July 2019

 when what they mean is that payment is to be made   WITHIN 28 days. Does that invalidate the PCN as not only is it totally meaningless but does not comply with the legal wording either.

           "

No, that is the discount period.  Dont start going up a blind alley and stick to  the fcats as they are. TO that end post up your NTK so we can read it and see if they have got it wrong as the wording has to use key phrases to be compliant with the POFA. Not compliant and they cant claim against anyone, let alone the keeper

dont send that appeal but do your own homework first.

 

Show us some pictures of the entrabce to the private land from the public highway and any signage there.

Show us close up images of the signs within the car park and note their location relative to where you parked.

 

Explain what the land is, ie residential, retail park or whatever and tell us why your vehicle was there.

 

for residential parking it is damned difficult for the parking co to prove they have a valid contract to enforec anything  as commonly they dont actually determine the terms of parking despite their signs.

 

it may be worth appealing after we have had a chance to consider everything but what you have written is ultimately meaningless waffle that will be spotted a mile off and you will be marked down  as being likely to pay up if pushed a bit more.

Do what DX suggests ericsbrother knows what makes these greedy PPCs tick and how to swat them away, the worse thing you can do for yourself is appeal, so just do as suggested, there is a well worn path that kills off these PPC claims and invoices.


We could do with some help from you.
