as should have read already

if by the time the actual mediation takes place

you will be asked the same q's as the N180.

its then you state they have still not provided you with all the necessary information to make an informed decision.

mediation will fail...as it always does.

and ofcourse moriarty never show in court so this case should then be an easy walk in the park as long as you DO.

Wait... They dont even have proof of a date of when the DN was sent etc

They have also told you that you need to get the DN from QQ...

No default Notice  =  Cant enforce the agreement.

 

87 Need for default notice

(1)Service of a notice on the debtor or hirer in accordance with section 88 (a " default notice ") is necessary before the creditor or owner can become entitled, by reason of any breach by the debtor or hirer of a regulated agreement.—

(a)to terminate the agreement, or

(b)to demand earlier payment of any sum, or

(c)to recover possession of any goods or land, or

(d)to treat any right conferred on the debtor or hirer by the agreement as terminated, restricted or deferred, or

(e)to enforce any security.

Would you suggest I contact the credit agencies as it’s only ever lantern that registered the default this year ? It is due to drop off in Nov anyway but it would be nice to get it gone

No..the non issuance of a default notice and the registering of a default are unconnected...its just the enforcement of the agreement thats affected.

Check with the court on the 17th Dec that the claimant has paid the hearing fee.....this is usually a good sign of how matters will proceed....if they have not paid the claim will be struck out ....demand it be struck out as per the Notice of Allocation.

 

Example Witness statement...the following is for a credit card not fixed loan as per your agreement...but it will give you an idea.
