      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi there, 

a few days ago i was caught on the bus with a fake 16+ oyster card by the inspector, she took my details and said tfl will contact me. 

 

i was dumb enough to get someone to apply for a 16+ oyster card for me after listening to a friend.

 

i really regret this and read a few threads about it.

 

I've received the letter from tfl yesterday asking me to explain why i didn't have a valid ticket.

 

what do i do can someone please help?

 

I'm really stressed about this, could i go prison?

 

could i get a criminal record, this would be my first offence if i get prosecuted. 

 

what's the worst case scenario that can happen?

8 journey's a week to and from work 4days a week

 

i read a few threads about this but what's the worst case scenario in my situation could i go prison?I'm scared if they look at this as fraud but most people in these threads that got prosecuted was for fare evasion

I don't think prison is likely, please stop worrying about that.

 

You will need to write back and tell the truth about what you've done,  in your own words. If you want us to look at what you plan to send, we're happy to help you to refine it.

 

Btw, did you buy the fake card online? You could offer to help TfL trace the person who took your money for the fake card.

Dear Sir or Madam,

 

 

 

 

I would like to apologize profusely for my actions in this occasion. I have pride in my integrity and honesty and I feel extremely ashamed of my very poor judgement.

 

I am currently working full-time. Previously to making this unethical decision I was going through a dark time in my life dealing with depression and financial difficulties. Which thus led me to making this foolish mistake. I live with my parents and I financially support them as my step father and myself are the sole income earners of the family. We both take care of my mother who deals with severe depression.  A criminal record on my part would be devastating for me and my family as it would affect my current employment. And or even future employment/opportunities.

 

 

This is the first caution or notice to prosecute that I have received in my life. Up until this point I have been a law-abiding citizen. I am very stressed in this situation as I have made a very grave mistake and I promise to never do anything like this ever again. I deeply regret my actions and would like to take a moment to apologize to TFL and it’s employee’s for my mishap.

 

 

As I stated before I have never been in a situation like this ever in my life. I know it was my mistake and I am very sorry. I truly had no idea it was such a grave crime until I received your letter stating possible prosecution.

 

 

I have no previous convictions to my name as I have been a productive member of society in the UK so far.

 

 

I have made a very bad mistake on my end that has kept me awake and tearful. I’m currently having anxiety at work and home just thinking about receiving a prosecution.

 

 

I would be very grateful if you would give me a second chance to right my wrongs.

 

 

I am more than willing to make immediate payment to cover the unpaid fare and any other damage or administration costs I have caused

it was a conscious act of fraud repeated twice daily for over 9mts!!

 

error of judgement on my behalf
